THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the date she entered active duty recorded on her DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected.

2.  The applicant states, in effect, that the date she entered active duty recorded on her DD Form 214 is incorrect.  The date, she states, should be 21 September 2003.  The date shown on her DD Form 214 is 14 September 2003.

3.  In support of her request, the applicant submitted a copy of Orders 
03-265-00024 prepared by Headquarters, 89th Regional Support Command, Wichita, Kansas, on 22 September 2003.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s service personnel record shows she enlisted in the Army Reserve with no prior service on 20 April 1983.  She served in the Reserve until 19 April 1991 when she was honorably discharged.  The applicant's records show that on 26 March 2001, the applicant again enlisted in the Reserve.  She served in the Reserve and on 21 September 2003 she was transferred to an Active Guard Reserve (AGR) status.  She was honorably discharged on 4 March 2008 in the rank and pay grade, Sergeant, E-5, under the provisions of Army Regulation 635-40 (Physical Evaluation for Retention, Retirement, or Separation), for disability with severance pay.

2.  Item 12.a. (Date Entered Active Duty this Period) of the applicant's DD Form 214 shows the date 14 September 2003.

3.  Orders 03-265-00024 prepared by Headquarters, 89th Regional Support Command, Wichita, Kansas, on 22 September 2003, show the applicant was released from her assignment with the 561st Combat Support Group, Omaha, Nebraska, with an effective date of 20 September 2003 and was assigned to the U.S. Army Reserve Control Group (AGR) on the following day.

4.  Item 12.c. (Net Active Service This Period) of the applicant's DD Form 214 shows she completed 4 years, 5 months, and 14 days of net active duty service this period.

5.  Army Regulation 635-5 (Separation Documents) prescribes policies and procedures regarding separation documents.  This regulation specifies that a DD Form 214 will be prepared for each Reserve component Soldier completing 90 days or more of continuous AGR service.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that the date she entered active duty shown on her DD Form 214, issued on 4 March 2008, is incorrect in that it should show
21 September 2003 as opposed to 14 September 2003 which is currently shown.

2.  The applicant's contention has merit.  The evidence shows the applicant enlisted in the Reserve with no prior service, on 20 April 1983.  She was honorably discharged on 19 April 1991.  The applicant again enlisted in the Reserve on 26 March 2001 and on 21 September 2003 she was transferred to the AGR.  She continued to serve in the AGR until she was honorably discharged for disability with severance pay on 4 March 2008.

3.  The applicant's net active service was calculated by subtracting the correct date of entry this period [21 September 2003] from the separation date this period [4 March 2008].  This service is correct as it is shown in Item 12c. of her DD Form 214.

4.  Based on the evidence of record, the applicant's request for correction of the date she entered active duty has merit and she is entitled to a correction of Item 12.a. of her DD Form 214 to show she entered active duty on 21 September 2003.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual be corrected by: 

   a.  deleting the entry (14 September 2003) from Item 12.a. of her DD Form 214 for the period ending 4 March 2008; and  

   b.  adding the entry 21 September 2003 in Item 12.a. of that DD Form 214.
