THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that item 18 (Remarks), of his DD Form 214 (Certificate of Release or Discharge from Active Duty), be corrected to show the entry "SERVICE IN IRAQ/KUWAIT:  JAN 11, 2005 – NOV 4, 2005" instead of the entry "SERVICE IN IRAQ/KUWAIT:  JAN 11, 2004 – NOV 4, 2005."

2.  The applicant states, in effect, that his DD Form 214 does not reflect the correct timeframe for his service in Iraq/Kuwait.  His service is incorrectly noted as “Jan 11, 2004” instead of “Jan 11, 2005.”

3.  The applicant provides a copy of his DD Form 214 in support of his request.

CONSIDERATION OF EVIDENCE:

1.  The applicant's record shows he enlisted in the New York Army National Guard (NYARNG) on 26 September 2003.  He was trained as an administrative specialist in military occupational specialty (MOS) 42L.  He was promoted to sergeant (SGT/E-5) effective 1 November 2005.

2.  The applicant was ordered to active duty on 29 August 2004 and was released from active duty on 14 December 2005.  He was transferred to a troop program unit (TPU) of the NYARNG. 



3.  Item 18 of the applicant's DD Form 214 shows he served in Iraq/Kuwait from 11 January 2004 through 4 November 2005.

4.  Information provided by the Defense Finance and Accounting Service (DFAS) revealed that the applicant served in Kuwait from 11 January 2005 through 4 November 2005. 

DISCUSSION AND CONCLUSIONS:

1.  Item 18 of the applicant's DD Form 214 shows service in Iraq/Kuwait from 11 January 2004 through 4 November 2005 which is incorrect.

2.  The information provided by DFAS revealed that the applicant served in Kuwait from 11 January 2005 through 4 November 2005 instead of from 11 January 2004 through 4 November 2005.  Therefore, he is entitled to correction of item 18 of his DD Form 214 to show the entry "SERVICE IN IRAQ/KUWAIT FROM 20050111 – 20051104."

3.  The applicant’s record should be corrected by deleting the current entry item 18 on his DD Form 214 and adding the entry "SERVICE IN IRAQ/KUWAIT FROM 20050111 – 20051104."

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
	
	a.  deleting the current entry in item 18 of the individuals DD Form 214 issued on 14 December 2005; and



	b.  adding in item 18 of the DD Form 214 issued on 14 December 2005 "SERVICE IN IRAQ/KUWAIT FROM 20050111 - 20051104".
