IN THE CASE OF:
BOARD DATE:
DOCKET NUMBER: AR20080009870
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his Bronze Star Medal (BSM) be added to his separation document (DD Form 214).
2. The applicant does not state anything in support of his request.
3. The applicant provides his DD Form 214 and a BSM certificate.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicants military records show that he enlisted in the Regular Army on 24 October 1966. He was awarded the military occupational specialty of radio relay carrier and was promoted to pay grade E-5. He served in Vietnam from 30 May 1968 to 29 May 1969.
3. On 29 May 1969, the applicant was honorably released from active duty as an overseas returnee. His DD Form 214 does not list the BSM.
4. The applicants records do not contain orders for the BSM or a recommendation for award of the BSM.
5. Army Regulation 600-8-104 (Military Personnel Information Management/Records) prescribes the policies governing the OMPF, the MPRJ, the Career Management Individual File, and Army Personnel Qualification Records. In pertinent part, this regulation states that for U.S. military decorations the only acceptable source documentation is the order, letter, or memorandum which awards the decoration. Award certificates, citations, or separation certificates alone will not be the basis for entry of a decoration.
6. Army Regulation 600-8-22 provides that the BSM is awarded to any person who distinguished himself by heroism or meritorious achievement or service, not involving participation in aerial flight in connection with military operations involving conflict with an opposing armed force. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. Recommendations must be made within 2 years of the event or period of service and the award must be made within 3 years.
DISCUSSION AND CONCLUSIONS:
1. While the applicant provided his BSM certificate, he did not provide the orders for his BSM. In accordance with Army Regulation 600-8-104, the only acceptable source documentation is the order, letter, or memorandum which awards the decoration.
2. Without orders, there is insufficient evidence in which to award the applicant the BSM.

Application for correction of military records (with supporting documents provided, if any). Unfortunately, the applicant's BSM certificate is insufficient evidence to show that he was awarded the BSM, in accordance with Army Regulation 600-8-104. Since there is no corroborating evidence to show that the applicant was awarded the BSM, there is insufficient basis in which to grant his request.
ARMY | BCMR | CY2009 | 20090003215
Application for correction of military records (with supporting documents provided, if any). The applicants records do not contain orders for the BSM or a recommendation for award of the BSM. Without orders, there is insufficient evidence to correct the applicants DD Form 214 to show award of the BSM.
ARMY | BCMR | CY2012 | 20120004459
The applicant states the award of the BSM is not on his DD Form 214. As a result, the DA Form 1577 is not sufficient as a basis for entitlement to a military award or for correction of military records to show a military award. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

This regulation also provides that the Republic of Vietnam Campaign Medal with Device (1960), a foreign award, was awarded to individuals who served in Vietnam for at least 6 months during the period 1 March 1961 to 28 March 1973, inclusive. Therefore, it would be appropriate to now correct the applicant's records to award him the first award of the Army Good Conduct Medal and to add it to his DD Form 214. As a result, the Board recommends that all Department of the Army records of the...
ARMY | BCMR | CY2007 | 20070015114
The applicant's military personnel record shows he was inducted into the Army of the United States on 6 November 1967. His military records also do not contain a copy of the BSM award order. The certificate showing award of the BSM is insufficient evidence without the respective awards order to correct the applicants DD Form 214.
ARMY | BCMR | CY2007 | 20070010083
The applicant's military service records do not contain orders for the award of the Army Good Conduct Medal. There is no evidence in the available applicant's military personnel record, which shows he was awarded the BSM. Therefore, the Board requests that the CMSD-St. Louis administratively correct the records of the individual concerned to show award of the Army Good Conduct Medal for the period of service from 7 August 1969 to 27 June 1971, the Sharpshooter Marksmanship Badge with Rifle...

The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show the awards of the Bronze Star Medal (BSM), Air Medal (AM) with "V" Device, and the Army Commendation Medal (ARCOM). The applicant's records show that he was awarded the Vietnam Service Medal. The certificate showing award of the BSM is insufficient evidence without the respective awards order to correct the applicants DD Form 214.

IN THE CASE OF: BOARD DATE: 8 February 2011 DOCKET NUMBER: AR20100019535 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. The applicant provides no documentation with his request. The applicant's record contains duplicate copies of the AAM and BSM Certificates.
ARMY | BCMR | CY2001 | 2001058833C070421
The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the Purple Heart (PH), the Bronze Star Medal (BSM) with "V" Device, and the Army Commendation Medal (ARCOM) as authorized awards. Item 41 (Awards and Decorations) lists the BSM with "V" Device, the PH, and the ARCOM. General Order Number 896 awarded the applicant the BSM for meritorious service; therefore, he is entitled to correction of his DD Form...

Army Regulation 672-5-1 (Military Awards), in effect at the time, provided that the Army Good Conduct Medal was awarded to individuals who had completed a qualified period of active duty enlisted service. However, the applicant's Bronze Star Medal with V Device orders show that he was wounded in action on 10 May 1970. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing he was awarded: the Purple Heart for wounds...
