THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his Certificate of Release or Discharge from Active Duty (DD Form 214) be corrected to show the correct dates that he served in Saudi Arabia.

2.  The applicant states, in effect, that his DD Form 214 reflects the incorrect dates of his service in Saudi Arabia as he was in Saudi Arabia from “19900901-19910338.”

3.  The applicant provides in support of his application, a copy of his DD Form 214; a copy of Order Number 017-3, showing that he was awarded the Army Achievement Medal; and a copy of his Leave and Earnings Statement for the period covering 1 September 1990 through 30 September 1990.

CONSIDERATION OF EVIDENCE:

1.  On 7 July 1987, the applicant enlisted in the Army in Harrisburg, Pennsylvania, for 4 years, in the pay grade of E-1.  He successfully completed his training as an armor specialist.  He remained on active duty through a series of reenlistments and extensions.

2.  After completing 20 years, 6 months and 24 days of net active service, the applicant retired on 31 January 2008, under the provisions of Army Regulation 635-200, chapter 12, due to obtaining sufficient service for retirement.

3.  The DD Form 214 that the applicant was furnished at the time of his retirement shows that he served in Saudi Arabia from 1 September 1991 through 28 March 1992.

4.  Information retrieved from the Gulf War Deployment Roster shows that the applicant served in Saudi Arabia from 1 September 1990 through 29 March 1991.

5.  Army Regulation 635-5 serves as the authority for the preparation of the 
DD Form 214.  It provides, in pertinent part, that the DD Form 214 will be prepared to reflect an individual’s service as it exists at the time of his release from active duty, discharge or retirement.

DISCUSSION AND CONCLUSIONS:

1.  It appears that an error was made during the preparation of the applicant’s 
DD Form 214 which resulted in the incorrect dates of his service in Saudi Arabia being reflected.

2.  Information retrieved from the Gulf War Deployment Roster shows that the applicant served in Saudi Arabia from 1 September 1990 through 29 March 1991 and his DD Form 214 should be corrected to reflect the correct dates of his service in Saudi Arabia.

3.  In view of the foregoing, it would now be in the interest of justice to correct the applicant's records as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 to show his dates of his service in Saudi Arabia as 1 September 1990 through 29 March 1991.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to amending the applicant’s DD Form 214 to show his dates of service in Saudi Arabia as “19900901-19910338.”
