	IN THE CASE OF:

	BOARD DATE: 15 July 2008

	DOCKET NUMBER: AR20080008255

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Combat Infantryman Badge.

2. The applicant states, in effect, that the award was left off his records due to an administrative oversight.

3. The applicant provides a copy of his DD Form 214, dated 20 November 2005, and a copy of Permanent Orders awarding him the Combat Infantryman Badge, in support of his application.

CONSIDERATION OF EVIDENCE:

1. The applicant's records show he enlisted in the Wisconsin Army National Guard (WIARNG) for a period of 8 years on 30 April 2001. He subsequently entered active duty, completed basic combat and advanced individual training, and was awarded military occupational specialty (MOS) 43M (Fabric Repairer).

2. On 13 June 2003, the applicant successfully completed the Army National Guard resident course for infantry training and was subsequently awarded MOS 11B (Infantryman) on 8 July 2003.

3. On 20 June 2004, the applicant was ordered to active duty in support of Operation Enduring Freedom and subsequently served in Iraq from 24 November 2004 to 29 October 2005. He was honorably released from active duty and reverted back to his ARNG status on 20 November 2005.
4. Item 13 (Decoration, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows he was awarded the Army Service Ribbon, the National Defense Service Medal, the Armed Forces Reserve Medal with “M” Device, the Global War on Terrorism Service Medal, and the Iraq Campaign Medal. Item 13 does not show award of the Combat Infantryman Badge.

5. Headquarters, 42nd Infantry Division, Forward Operations Base Danger, Tikrit, Iraq, Permanent Orders 281-87, dated 8 October 2005, show the applicant was awarded the Combat Infantryman Badge for actively engaging or being engaged by the enemy on 1 January 2005.

DISCUSSION AND CONCLUSIONS:

Permanent orders awarded the applicant the Combat Infantryman Badge which is not shown on his records; therefore, he is entitled to correction of his records to show this award.

BOARD VOTE:

__xxx___ __xxx___ __xxx___ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

BOARD DETERMINATION/RECOMMENDATION:

On 14 May 2003, the applicant was ordered to active duty in support of Operation Noble Eagle, in MOS 11B. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry military occupational specialty (MOS). However, the evidence of record shows that he was assigned or attached to a Military Police unit during his service in Iraq.

Application for correction of military records (with supporting documents provided, if any). There is no evidence in the applicant’s records and the applicant did not provide any substantiating evidence that shows he actively engaged or was engaged by the enemy. Therefore, there is insufficient evidence to award the applicant the Combat Action badge in this case.

The applicant requests correction of his records to show he was awarded the Combat Infantryman Badge (CIB) instead of the Combat Action Badge (CAB) and that he contributed to the MGIB. Upon confirmation from their chain that the enemy was setting up a mortar system for an indirect fire attack, he and the other two Soldiers fired an initial volley of three high-explosive (HE) rounds. Furthermore, the applicant evidence of record shows that the applicant held an infantry MOS and engaged the...

For example, an 11B assigned to an infantry battalion is not eligible for award of the CAB. The evidence clearly shows that the applicant was assigned to a civil affairs battalion at the time he was awarded the Combat Action Badge. Evidence shows that the applicant’s records contain administrative error which does not require action by the Board.
