THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his Certificate of Release or Discharge from Active Duty (DD Form 214) be corrected to show that he was awarded the Meritorious Unit Commendation (MUC).

2.  The applicant states that orders were issued awarding him the MUC after he was separated from the military.

3.  The applicant provides in support of his application, a copy of his Officer Evaluation Report for the period 1 January 2005 through 12 July 2005; a copy of Permanent Orders 334-05 dated 30 November 2007; a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  On 4 May 2002, the applicant accepted a commission as a second lieutenant (O-1) in the United States Army Reserve (USAR).  He was ordered to active duty on 1 December 2002.  He was promoted to first lieutenant on 22 April 2004.

2.  After completing 3 years of net active service, the applicant was honorably released from active duty (REFRAD) on 30 November 2005 and he was transferred to the USAR Control Group (Reinforcement) to complete his Reserve obligation.



3.  The DD Form 214 that the applicant was furnished at the time of his REFRAD shows that he was awarded the Army Commendation Medal (2nd Award), the Army Achievement Medal, the National Defense Service Medal, the Army Service Ribbon, the Combat Infantryman Badge, the Expert Infantryman Badge, the Parachutist Badge, the Global War on Terrorism Expeditionary Medal, the Global War on Terrorism Service Medal, and the Iraq Campaign Medal.

4.  The applicant's DD Form 214 also shows that he had service in Kuwait/Iraq from 17 January 2005 through 15 June 2006 and that he had service in Iraq from 28 October 2003 through 28 March 2004.  

5.  On 30 November 2007, Permanent Orders 334-05 was published awarding the unit to which the applicant was assigned, the MUC for exceptionally meritorious conduct during the period 19 June 2004 through 19 June 2005.

6.  Army Regulation 600-8-22 (Military Awards), in pertinent part, states that effective 1 March 1961 the Meritorious Unit Commendation was authorized for units and/or detachments of the Armed Forces of the United States for exceptionally meritorious conduct in the performance of outstanding services for at least six continuous months in support of military operations.  

DISCUSSION AND CONCLUSIONS:

1.  The available records indicate that the applicant is entitled to the inclusion of the MUC on his DD Form 214.

2.  The unit to which the applicant was assigned was awarded the MUC in Permanent Orders 334-05, which was published on 30 November 2007.  Therefore, this award should be included on his DD Form 214.

3. In view of the foregoing, it would now be appropriate to correct the applicant's record as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 to show that he was awarded the Meritorious Unit Commendation.
