IN THE CASE OF:
BOARD DATE: 25 October 2012
DOCKET NUMBER: AR20120008028
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Meritorious Unit Commendation (MUC).
2. The applicant states his unit was awarded the MUC during his tenure of assignment in Iraq.
3. The applicant provides the following evidence:
* DD Form 214, dated 26 August 2005
* DD Form 215, dated 25 April 2012
* Army Review Boards Agency letter, dated 18 April 2012
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Army National Guard (ARNG) on 8 September 1999.
2. On 1 October 2001 while serving in the New York ARNG, the applicant was ordered to active duty in support of Operation Iraqi Freedom and deployed to Kuwait/Iraq from 26 February through 31 December 2004. During this period, he was assigned to and served with the 2nd Battalion, 108th Infantry. He was released from active duty on 26 August 2005.
3. Multi-National Force-Iraq Permanent Orders 104-015, dated 14 April 2005, awarded Task Force 2nd Battalion, 108th Infantry, the MUC for exceptionally meritorious service during ground operations against enemy forces in Ad Dujayl, Iraq, during the period 15 February to 26 December 2004.
4. His DD Form 214 for this period of service, as amended by a DD Form 215, included the following awards:
* National Defense Service Ribbon
* Global War on Terrorism Expeditionary Medal
* Global War on Terrorism Service Medal
* Armed Forces Reserve Medal with "M" Device
* Army Service Ribbon
* Combat Infantryman Badge
* Army Good Conduct Medal
* Overseas Service Ribbon
* Valorous Unit Award
* Sharpshooter Marksmanship qualification Badge with Rifle and Grenade Bars
DISCUSSION AND CONCLUSIONS:
1. The applicant's contention that the MUC should be added to his DD Form 214 has been carefully considered and found to have merit.
2. The evidence of record shows the applicant served with the 2nd Battalion, 108th Infantry, in Iraq from 26 February through 31 December 2004. It further confirms the MUC was awarded to this unit for meritorious service in Iraq from 15 February to 26 December 2004 during the applicant's period of assignment.
3. In view of the foregoing, it would be appropriate to add the MUC to his DD Form 214 at this time.
