THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that his record and separation document 
(DD Form 214) be corrected to reflect award of the Army Commendation Medal (ARCOM) with 2nd Oak Leaf Cluster (3rd Award).  

2.  The applicant states, in effect, that at the time of his separation, he did not have the necessary documents to show he actually had three awards of the ARCOM, and as a result, his DD Form 214 only reflects two awards of the ARCOM.  He further states that he would now like for his DD Form 214 to be corrected to reflect his entitlement to the ARCOM with 2nd Oak Leaf Cluster 
(3rd Award).
 
3.  The applicant provides three DA Forms 638 (Recommendations for Award) and certificates for award of the ARCOM in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's record shows he enlisted into the Regular Army and entered active duty on 27 February 2003.  He was trained in and awarded military occupational specialty (MOS) 25U (Signal Support System Specialist).

2.  The applicant's Enlisted Record Brief (ERB), dated 31 December 2007, shows he received one award of the ARCOM in Section VIII (Awards and Decorations). 


3.  On 27 February 2008, the applicant was honorably released from active duty (REFRAD), in the rank of specialist (SPC).  The DD Form 214 he was issued at the time shows he completed a total of 5 years and 1 day of active military service.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) shows he earned the following awards during his tenure on active duty:  Army Commendation Medal (2nd Award); Navy Unit Commendation; Army Good Conduct Medal (AGCM); National Defense Service Medal (NDSM); Global War on Terrorism Expeditionary Medal (GWOTEM); Global War on Terrorism Service Medal (GWOTSM); Iraq Campaign Medal (ICM); Army Service Ribbon (ASR); Overseas Service Ribbon (OSR); Combat Action Badge; and Driver and Mechanic Badge.  

4.  The applicant provided DA Forms 638 and certificates that indicate he was awarded the ARCOM for meritorious service during the period 18 March 2004 through 10 December 2004 and this award was authorized and announced in Headquarters, 39th Brigade Combat Team, Camp Cooke, Iraq, Permanent Orders 020-31, dated 20 January 2005.  The applicant was awarded the ARCOM with 1st Oak Leaf Cluster (2nd Award) for meritorious service during the period 
5 October 2006 through 4 October 2007, and this award was authorized and announced in Headquarters, 3rd Brigade, 1st Cavalry Division Permanent Orders 128-166, dated in May 2007.  Finally, upon his expiration of term of service (ETS), he was awarded the ARCOM for meritorious service during the period 
21 October 2003 through 1 February 2008, and this award was authorized and announced in Headquarters, 3rd Brigade, 1st Cavalry Division Permanent Orders 252-007, dated 14 October 2007.  

DISCUSSION AND CONCLUSIONS:

The applicant's contention that he received three awards of the ARCOM was carefully considered and found to have merit.  The evidence includes award recommendations and orders confirming the applicant was awarded the ARCOM for three separate periods of meritorious service, the last being in conjunction with his ETS, as evidenced by the three DA Forms 638 and ARCOM certificates provided by the applicant.  Therefore, it would be appropriate to correct his record and separation document accordingly.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214, dated 27 February 2008, by deleting the current Army Commendation Medal entry and replacing it with the entry Army Commendation Medal 2nd Oak Leaf Cluster (3rd Award); and by providing him a correction to his separation document that includes this change.
