THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that item 19a (Mailing Address after Separation) on his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show an address in Milroy, IN.  He also requests that item 19b (Nearest Relative) of his DD Form 214 be corrected to show his spouse, K_____n S___h B________r, at the same address as in item 19a.

2.  The applicant states that he married on 23 July 2005.

3.  The applicant provides two copies of his DD Form 214 and his marriage certificate.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 21 October 2004.

2.  The applicant married on 23 July 2005.

3.  The applicant was retired by reason of permanent disability on 27 December 2007.  He was not available to sign his DD Form 214.  Item 19a of his DD Form 214 shows an address in Rushville, IN, and item 19b shows G_____y A. B________r as his nearest relative with the same address in Rushville, IN.

4.  Army Regulation 635-5 prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  In pertinent part, it states the entries in items 19a and 19b will be provided by the Soldier.

DISCUSSION AND CONCLUSIONS:

1.  The applicant was not available to sign his DD Form 214, and it is possible the office that prepared his DD Form 214 was not aware that he was married or that his spouse resided in Milroy, IN.

2.  Since it appears the applicant requested correction of his DD Form 214 almost immediately upon learning of the errors, his DD Form 214 should be corrected as requested.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 in item 19a to show the address 3__7 West 900 South, Milroy, IN 46156, and in item 19b to show his nearest relative as his spouse, S___h K_____n B________r, with the same address in Milroy, IN.
