THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, reconsideration of his earlier application requesting correction of the organization listed in Item 6 (Organization) of his separation document (WD AGO Form 53-55).
2. The applicant states, in effect, that his separation document lists Squadron Headquarters, 89th Cavalry Reconnaissance Squadron (Mechanized) as his organization; however, his actual organization was Squadron Headquarters,
25th Cavalry Regiment Reconnaissance, 4th Armored Division, 3rd Army.
3. The applicant provides change of address cards and newspaper article extracts as new evidence in support of his reconsideration request.
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20060000223, on 10 August 2006.
2. During its original review of the case, the Board acknowledged that the applicant was assigned to the 25th Cavalry Regiment Reconnaissance,
4th Armored Division, 3rd Army, while serving in the European Theater of Operations (ETO).
3. However the Board also determined that after his return to the United States, he was reassigned to Headquarters, 89th Cavalry Reconnaissance Squadron (Mechanized) on 13 July 1945, and that he served in that unit until being assigned to the separation activity for separation processing on 13 October 1945. As a result, the Board concluded this was his last permanent assignment and that there was no error or injustice related to the entry in Item 6 of the applicant's separation document.
4. The applicant provides change of address cards, dated 29 December 1943, which show his address as Headquarters and Service Troop, 25th Cavalry Reconnaissance Squadron Mechanized, as his address in the ETO, and a newspaper article extract that contains a story indicating he was serving in the 3rd Army in the ETO. He also again provides documents and photographs previously considered by the Board.
5. The applicant's Service Record (WD AGO Form 24) contains entries confirming the applicant was assigned to Headquarters and Service Troop,
25th Cavalry Reconnaissance Squadron Mechanized, while serving in the ETO. The record also contains entries that verify that upon his return to the United States, he was assigned to Headquarters, 89th Cavalry Reconnaissance Squadron (Mechanized) on 13 July 1945, and that this was the last organization he was permanently assigned to and served with prior to his assignment to the separation activity for processing on 13 October 1945.
6. On 24 October 1945, the applicant was honorably separated after completing a total of 3 years, 4 months, and 21 days of active military service. The separation document he was issued lists Squadron Headquarters, 89th Cavalry Reconnaissance Squadron (Mechanized) in Item 6, and the applicant authenticated this document with his signature in Item 56 (Signature of Person Being Separated) on the date of his separation.
7. Technical Manual 12-235, which prescribed the policy and procedure for the preparation and distribution of separation documents during the period in question, states that the last unit, or similar element to which the individual was assigned, rather than the element of which he was part while moving to a separation activity will be entered in Item 6 (Organization) of the WD AGO Form 53-55.
DISCUSSION AND CONCLUSIONS:
1. The applicant's request for reconsideration was carefully considered. However, there is insufficient evidence to support amendment of the original Board decision in this case.
2. The evidence of record confirms that although the applicant served in Headquarters and Service Troop, 25th Cavalry Reconnaissance Squadron Mechanized, while serving in the ETO, his last permanent duty station prior to movement to the separation activity for separation processing was Headquarters, 89th Cavalry Reconnaissance Squadron (Mechanized), as is indicated in Item 6 of his separation document. As a result, there appears to be no error or injustice related to this entry.
3. Further, as indicated in the original Board decisional document, the applicant's Service Record documents his service in the 25th Cavalry Regiment Reconnaissance, 4th Armored Division, 3rd Army. Therefore, the applicant's record properly credits him with service in this unit in the ETO, and it appears he has suffered no injustice as a result of the correct organization entry contained in Item 6 of his separation document. As a result, absent any evidence of an error or injustice related to the organization entry in question, there is an insufficient evidentiary basis to support granting the requested relief in this case.
