THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show he received three awards of the Bronze Star Medal.

2.  The applicant states he was awarded the Bronze Star Medal (2nd Oak Leaf Cluster); however, the award is not recorded on his DD Form 214.

3.  The applicant provides copies of an amendment to his Bronze Star Medal award orders and his 30 June 1972, DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  A WD AGO Form 53-55 (Enlisted Record and Report of Separation - Honorable Discharge) shows the applicant was inducted into the Army of the United States on 2 March 1943, he entered active duty on 9 March 1943, and was honorably discharged on 6 December 1945 to reenlist.  It shows in:

	a.  item 6 (Organization):  549th Quartermaster Laundry Company;

	b.  item 32 (Battles and Campaigns):  Normandy, Northern France, and Rhineland campaigns;

	c.  item 33 (Decorations and Citations):  European-African-Middle Eastern Campaign Medal with 3 bronze service stars; and

	d.  item 36 (Service Outside Continental U.S. and Return):  he departed the European Theater of Operations (ETO) on 18 January 1944 and arrived in the U.S. on 29 January 1944.

	e.  He completed 7 days of inactive service; 10 months and 9 days of continental service; and 1 year, 10 months, and 18 days of foreign service.

3.  A WD AGO Form 53 (Enlisted Record and Report of Separation - Honorable Discharge) shows the applicant entered active duty in the Regular Army (RA) on 7 December 1945 and he was honorably discharged on 6 December 1948 to reenlist in the RA.  It shows in:

	a.  item 6 (Organization):  Company C, 758th Heavy Tank Battalion;

	b.  item 32 (Battles and Campaigns):  "None;"

	c.  item 33 (Decorations and Citations):  Army of Occupation Medal [with Germany Clasp] and World War Victory Medal;

	d.  item 36 (Service Outside Continental U.S. and Return):  he served in Germany through 15 December 1945 and in the ETO from 13 June 1946 through 
13 November 1947; and

	e.  item 55 (Remarks):  no time lost.

	f.  He completed 1 year, 5 months, and 8 days of continental service and 
1 year, 6 months, and 22 days of foreign service.

4.  The applicant's DA Form 24A (Service Record), covering the period of service from 7 December 1948 through 16 October 1951, shows in:
	a.  section 7 (Combat Record):  Chinese Communist Forces (CCF) Intervention, First United Nations (UN) Counteroffensive, and CCF Spring Offensive campaigns;

	b.  section 9 (Remarks - Administrative):  he was discharged on 16 October 1951, his character and efficiency were both rated as "excellent," and he had
34 months and 10 days of continuous service credit toward the Good Conduct Medal;

	c.  section 14 (Service Outside Continental United States):  he departed San Francisco, CA on 30 August 1950; arrived in Japan on 14 September 1950; departed Japan on 17 November 1950; and arrived in Korea on 19 November 1950;

	d.  section 21 (Medals, Decorations, and Citations):  World War II Victory Medal, Army of Occupation Medal [with Japan Clasp], Bronze Star Medal with "V" Device, and Korean Service Medal with 3 bronze service stars; and

	e.  section 24 (Indorsements), 1st Indorsement, the first lieutenant serving as the recruiting officer favorably considered the applicant for the Good Conduct Medal on 7 December 1948.

5.  Headquarters, 3rd Infantry Division, General Orders (GO) Number 229, dated 27 June 1951, awarded the applicant the Bronze Star Medal with "V" Device for heroism in action in the Republic of Korea (ROK) on 27 March 1951.

6.  A DD Form 214 (Report of Separation from the Armed Forces of the United States) shows the applicant entered active duty this period on 7 December 1948 and he was honorably discharged on 16 October 1951 to reenlist in the RA.  He completed 2 years, 10 months, and 10 days of net active service this period.  It shows in:

	a.  item 26 (Foreign and/or Sea Service):  1 year, 1 month, and 17 days;

	b.  item 27 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized):  Bronze Star Medal with "V" Device, Korean Service Medal with 3 bronze service stars, and 1 Overseas Service Bar;

	c.  item 28 (Most Significant Duty Assignment):  Company C, 64th Heavy Tank Battalion [3rd Infantry Division]; and

7.  A DD Form 214 shows the applicant entered active duty this period on
17 October 1951 and he was honorably discharged on 12 December 1957 to reenlist in the RA.  He completed 6 years, 1 month, and 26 days of net active service this period.  It shows in:

	a.  item 26 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized):  Army of Occupation Medal with Germany Clasp, Marksman Marksmanship Qualification Badge with Carbine and Submachine Gun Bars, Bronze Star Medal, and Good Conduct Medal; and

8.  A DD Form 214 shows the applicant entered active duty this period on
13 December 1957 and he was honorably discharged on 12 December 1963 to reenlist in the RA.  He completed 6 years of net active service this period.  It shows in:

	a.  item 26:  "N/A" [Not Applicable]; and

	b.  item 32 (Remarks):  no time lost.

9.  A DD Form 214 shows the applicant entered active duty this period on
13 December 1963 and he was honorably discharged on 12 December 1966 to reenlist in the RA.

	a.  He completed 3 years of net active service this period.

	b.  Item 26:  Expert Marksmanship Qualification Badge with Rifle (M-14) Bar, Bronze Star Medal, Good Conduct Medal (4th Award), and National Defense Service Medal with Oak Leaf Cluster.

10.  Headquarters, 25th Infantry Division, GO Number 2438, dated 2 April 1968, as amended by GO Number 5242, dated 19 July 1968, awarded the applicant the Bronze Star Medal with "V" Device (1st Oak Leaf Cluster) for heroism in action in the Republic of Vietnam (RVN) on 6 March 1968.

11.  Headquarters, 25th Infantry Division, GO Number 6112, dated 27 August 1968, as amended by GO Number 7220, dated 10 October 1968, awarded the applicant the Bronze Star Medal [with "V" Device] (2nd Oak Leaf Cluster) for meritorious service in the RVN from October 1967 to October 1968.


12.  The applicant's DA Form 20 (Enlisted Qualification Record) shows in:

13 December 1966 and he was honorably discharged on 12 December 1969 to reenlist in the RA.  He completed 3 years of net active service this period.  It shows in:

13 December 1969 and he was honorably retired on 30 June 1972.  He completed 2 years, 6 months, and 18 days of net active service this period.  It shows in:

	a.  item 24:  Sharpshooter Marksmanship Qualification Badge with Rifle
(M-14) Bar, Army Commendation Medal, and National Defense Service Medal with 1st Oak Leaf Cluster; and

	b.  item 26a:  "None."

15.  A review of the applicant's military personnel records reveals that he may be authorized additional awards that are not shown on his DD Forms 214.

16.  Headquarters, U.S. Army Air Defense Center, Fort Bliss, Texas, GO Number 98, dated 27 September 1967, awarded the applicant the Army Commendation Medal for meritorious service from 1 November 1965 to 1 August 1967.

17.  Headquarters, 1st Infantry Division (Mechanized), Fort Riley, Kansas,
GO Number 255, dated 27 June 1972, awarded the applicant the Army Commendation Medal [2nd Award] for meritorious service from 1 April 1970 to
30 June 1972.

18.  Headquarters, U.S. Army Armored Maintenance Group [Germany], GO Number 27, dated 26 August 1963, awarded the applicant the Good Conduct Medal (3rd Award) for exemplary behavior, efficiency, and fidelity for the period
25 August 1960 to 24 August 1963.

19.  Headquarters, U.S. Army Training Center (Air Defense), Fort Bliss, Texas, GO Number 142, dated 19 September 1966, awarded the applicant the Good Conduct Medal (4th Award) for exemplary behavior, efficiency, and fidelity for the period 25 August 1963 to 24 August 1966.

20.  Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register), dated 6 July 1961, lists the unit awards received by units and campaign participation of units serving in World War II and the Korean War.  This document shows that during the applicant's assignment to the:

	a.  549th Quartermaster Laundry Company (ETO), the unit was awarded the:

		(1)  Meritorious Unit Commendation for meritorious service for the period 15 August 1944 to 5 May 1945 by Headquarters, 7th Army, GO Number 389, dated 10 August 1945;

		(2)  assault landing credit in Southern France on 15-16 August 1944 by War Department GO Number 70 (1945); and

		(3)  occupation credit in Germany from 2 May through 31 October 1945;

	b.  64th Tank Battalion, 3rd Infantry Division (ROK), the battalion:

		(1)  participated in the CCF Intervention, First UN Counteroffensive, CCF Spring Offensive, and UN Summer-Fall Offensive campaigns; and

		(2)  was cited for award of the:

		(a)  Republic of Korea Presidential Unit Citation for the period 18 April through 11 May 1951 by Department of the Army (DA) GO Number 20 (1953); and

		(b)  Bravery Gold Medal of Greece [Unit Citation] for the period of the Korean War by DAGO 2 (1956).

21.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) was published to assist commanders and personnel officers in determining or establishing the eligibility of Soldiers for campaign participation credit, assault landing credit, and unit citation badges awarded during the Vietnam Conflict.  This pamphlet shows that at the time of the applicant's assignment to:

	a.  Headquarters and Headquarters Troop, 3rd Squadron, 4th Cavalry, the squadron was awarded the:

		(1)  Presidential Unit Citation for extraordinary heroism in combat on 
31 January 1968 in the RVN by DAGO Number 69, dated 7 November 1969;

		(2)  Republic of Vietnam Gallantry Cross with Palm Unit Citation by DAGO Number 48 (1971); and

		(3)  Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation by DAGO Number 51 (1971).

	b.  Table B-1 contains a list of Vietnam Conflict campaigns and shows that during the applicant's tour in Vietnam from 2 October 1967 through 1 October 1968, participation credit was awarded for the following campaigns:

* Vietnam Counteroffensive Phase III  (1 June 1967- 29 January 1968)
* Tet Counteroffensive  (30 January - 1 April 1968)
* Vietnam Counteroffensive Phase IV  (2 April - 30 June 1968)
* Vietnam Counteroffensive Phase V (1 July - 1 November 1968)

22.  Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations.

	a.  The Bronze Star Medal is awarded in time of war for heroism and for meritorious achievement or service, not involving participation in aerial flight, in connection with military operations against an armed enemy, or while engaged n military operations involving conflict with an opposing armed force in which the United States is not a belligerent party.

		(1)  The bronze "V" device indicates acts of heroism involving conflict with an armed enemy and authorizes the device in conjunction with award of the Bronze Star Medal.  Although more than one award of the Bronze Star Medal may be made for heroism to the same person, only one "V" device may be worn on the medal.

		(2)  An oak leaf cluster is awarded to denote the second and each succeeding award of certain decorations, among which is the Bronze Star Medal, Purple Heart, and Army Commendation Medal.

	b.  The Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service.  This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service.

		(1)  The enlisted Soldier must have had all "excellent" conduct and efficiency ratings.  Ratings of "unknown" for portions of the period under consideration were not disqualifying.  In addition, service school efficiency ratings based upon academic proficiency of at least "good" rendered subsequent to 
22 November 1955 were not disqualifying.

		(2)  There must have been no convictions by a court-martial.

		(3)  There was no right or entitlement to the medal until the immediate commander made a positive recommendation for its award and until the awarding authority announced the award in general orders.  Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.

	c.  The European-African-Middle Eastern Campaign Medal is awarded for service within the European African-Middle Eastern Theater between 7 December 1941 and 8 November 1945.  This medal is awarded to any service member who was permanently assigned in the theater, who was in a passenger status or on temporary duty for 30 consecutive days or 60 non-consecutive days.

		(1)  The "arrowhead" device is authorized for wear on European-African-Middle Eastern Campaign Medal to denote participation in a combat parachute jump, helicopter assault landing, combat glider landing, or amphibious assault landing while assigned or attached as a member of an organized force carrying out an assigned tactical mission.  Individual assault credit is tied directly to the combat assault credit decision for the unit to which the Soldier is assigned.  The unit must be credited with a combat assault in order for the Soldier to receive credit for a combat assault and the Soldier must physically exit the aircraft or the watercraft, as appropriate.

		(2)  A bronze service star is authorized with the European-African-Middle Eastern Campaign Medal for each ETO campaign a member is credited with participating in.

	d.  The Korean Service Medal is awarded for qualifying service in the Korea theater of operations between 27 June 1950 and 27 July 1954.  A bronze service star is authorized with the Korean Service Medal for each Korean War campaign a member is credited with participating in.

	e.  The Vietnam Service Medal is awarded for qualifying service in the Vietnam theater of operations after 3 July 1965 through 28 March 1973.  A bronze service star is authorized with the Vietnam Service Medal for each Vietnam campaign a member is credited with participating in.

	f.  The Army of Occupation Medal is awarded for service of 30 consecutive days at a normal post of duty in a qualifying location.  Personnel at a qualifying location as an inspector, courier, and escort on temporary or detached duty are precluded from eligibility.

		(1)  For award of the Army of Occupation Medal with Germany Clasp, qualifying service must have occurred between 9 May 1945 and 5 May 1955.  Service between 9 May 1945 and 8 November 1945 will be counted only if the European-African-Middle Eastern Campaign Medal was awarded for service before 9 May 1945.

		(2)  For award of the Army of Occupation Medal with Japan Clasp, qualifying service in Japan included service in the Japanese home islands, the Ryukyu Islands, and the Bonin-Volcano Islands between 3 September 1945 and 27 April 1952.

	g.  The National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined.

	h.  The United Nations Service Medal is awarded to members of the Armed Forces of the United States dispatched to Korea or adjacent areas on behalf of the United Nations during the period between 27 June 1950 and 27 July 1954.  Personnel awarded the Korean Service Medal automatically establish eligibility for the United Nations Service Medal.

	i.  The Republic of Korea War Service Medal is awarded to members of the U.S. Armed Forces who served in Korea and adjacent waters between 25 June 1950 and 27 July 1953.  The service must have been performed, in part, while on permanent assignment for 30 consecutive days or on temporary duty for 
30 consecutive or 60 non-consecutive days within the territorial limits of Korea or the waters immediately adjacent thereto.

	j.  The Republic of Vietnam Campaign Medal with Device (1960) was awarded by the Government of Vietnam to all members of the Armed Forces of the United States for qualifying service in Vietnam during the period 1 March 1961 through 28 March 1973.  Qualifying service included assignment in Vietnam for 6 months or more.

23.  Army Regulation 670-1 (Uniforms and Insignia) governs the requirements for the Overseas Service Bar.  It states a bar is authorized for wear for each period of active Federal service as a member of the U.S. Army outside of the continental limits of the United States for the specific time frames and areas of operation cited in Army Regulation 670-1 or appropriate Department of the Army message.  For service during World War II, the Korean War, and Vietnam Conflict, one overseas service bar was authorized for each period of 6 months active Federal service as a member of a U.S. Service in the theater of operations.

24.  War Department Technical Manual (TM) 12-235 (Enlisted Personnel - Discharge and Release from Active Duty), dated January 1945, in effect at the time of the applicant's discharge on 6 December 1945 and 6 December 1948, prescribed uniform procedures in discharging or releasing personnel from active duty.  The instructions for completing the WD AGO Form 53 state that the form is completed from the Service Record, Soldier's Qualification Card, Immunization Register, and information ascertained by interview with the dischargee.  The instructions for completing item 33 state enter decorations or citations [for the period covered].

25.  Service Regulations Number 615-360-1 (Discharge Procedures and Preparation of Separation Forms), in effect at the time of the applicant's discharge on 16 October 1951, prescribed the discharge procedures and separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army.  It also established standardized policy for preparing and distributing the DD Form 214.  The instructions for completing item 27 state to enter decorations or citations received during period covered by the DD Form 214.

26.  Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribed policies and procedures regarding separation documents.  It also established standardized policy for preparing and distributing the DD Form 214.

	a.  The version in effect  at the time of the applicant's discharge on 
12 December 1957, 12 December 1963, and 12 December 1966, show the instructions for completing item 26 state enter decorations awarded or authorized during period covered by the DD Form 214, omitting authorities cited therein.

	b.  The version in effect  at the time of the applicant's discharge on 
12 December 1969 and 30 June 1972, show the instructions for completing item 24 state enter all [emphasis added] decorations, service medals, campaign credits, and badges awarded or authorized, omitting authorities cited therein.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 should be corrected to show he received three awards of the Bronze Star Medal.

2.  General orders awarded the applicant the Bronze Star Medal with "V" Device for heroism on two separate occasions and the Bronze Star Medal for meritorious service on one occasion.  Thus, he is entitled to corrections of his records to show award of the Bronze Star Medal with "V" Device (2nd Oak Leaf Cluster).

3.  General orders awarded the applicant two awards of the Army Commendation Medal.

4.  The applicant had continuous honorable active duty service from 9 March 1943 through 30 June 1972.

	a.  He received "excellent" conduct and efficiency ratings during his service, except for a period of approximately 2 months when he received ratings of "unknown", which are not disqualifying.

	b.  He received four awards of the Army Good Conduct Medal (thru 24 August 1966).

	c.  There is no evidence of any time lost, disciplinary actions, adverse information, or a commander's disqualification for the Army Good Conduct Medal at any period during the applicant's long and distinguished period of service.

	d.  Based on the available evidence, it would be appropriate to revoke the previously issued awards of the Army Good Conduct Medal and award the applicant nine awards of the Army Good Conduct Medal for the periods of service, as follows:

* from 9 March 1943 to 8 March 1946 (1st Award)
* from 9 March 1946 to 8 March 1949 (2nd Award)
* from 9 March 1949 to 8 March 1952 (3rd Award)
* from 9 March 1952 to 8 March 1955 (4th Award)
* from 9 March 1955 to 8 March 1958 (5th Award)
* from 9 March 1958 to 8 March 1961 (6th Award)
* from 9 March 1961 to 8 March 1964 (7th Award)
* from 9 March 1964 to 8 March 1967 (8th Award)
* from 9 March 1967 to 8 March 1970 (9th Award)

5.  Records show the applicant received assault credit for participation in the invasion of Southern France and he participated in three campaigns during his service in the ETO.  Therefore, he is entitled to the "arrowhead" device and three bronze service stars for wear on his already-awarded European-African-Middle Eastern Campaign Medal.

6.  Records show the applicant participated in four campaigns during his service in the ROK.  Therefore, he is entitled to four bronze service stars for wear on his already-awarded Korean Service Medal.

7.  Records show the applicant participated in four campaigns during his service in the RVN.  Therefore, he is entitled to four bronze service stars for wear on his already-awarded Vietnam Service Medal.

8.  Records show the applicant qualified for the:

* Army of Occupation Medal with Germany and Japan Clasps
* National Defense Service Medal (1st Oak Leaf Cluster) for his service during the Korean War and Vietnam Conflict
* United Nations Service Medal and Republic of Korea War Service Medal for his service in the Korean War
* Republic of Vietnam Campaign Medal for his service in the Vietnam Conflict

9.  General orders awarded the applicant's units the:

* Presidential Unit Citation [RVN]

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
