THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his DD Form 214 be corrected to reflect his deployment to Iraq in support of Operation Iraqi Freedom during the period of 1 May 2003 to 30 April 2004 and his award of the Combat Medical Badge (CMB).

2.  The applicant states, in effect, that the information regarding his deployment to Iraq in support of Operation Iraqi Freedom during the period of 1 May 2003 to 30 April 2004 and his award of the CMB were omitted from his DD Form 214 at the time of his discharge. 

3.  The applicant provides a copy of orders awarding him the CMB and a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the pay grade of E-4 on 15 October 1997 for a period of 4 years and training as a medical specialist.  He completed his training and was transferred to Fort Hood, Texas.  He was promoted to the pay grade of E-5 on 1 May 2001. 

2.  On 3 May 2001, he reenlisted for a period of 4 years and assignment to Europe.  He was transferred to Germany on 30 August 2001. 

3.  Information obtained from the Defense Finance and Accounting Service (DFAS) shows that the applicant arrived in Iraq on 3 May 2003 and departed on 3 April 2004.  He was paid hostile fire pay for the period of 1 May 2003 through 30 April 2004, since hostile fire pay is a monthly entitlement.  

4.  Meanwhile, on 8 July 2003, Permanent Orders Number 189-72 issued by 2nd Brigade, 1st Armored Division – Iraq, awarded the applicant the CMB.

5.  The applicant departed Germany on 29 August 2004 and was transferred to Fort Jackson, South Carolina where he remained until he was honorably discharged due to completion of required service.  His DD Form 214 issued at the time of his discharge fails to reflect the period he served in Iraq and his award of the CMB.

6.  Army Regulation 635-5 serves as the authority for the preparation of the DD Form 214.  It provides, in pertinent part, that an entry will be made in the REMARKS section of the DD Form 214 to reflect “Service in (name of Country deployed) from and to dates.”  

DISCUSSION AND CONCLUSIONS:

1.  The applicant served in Iraq from 3 May 2003 to 3 April 2004 in support of Operation Iraqi Freedom.  Accordingly, he is entitled to have the entry “Service in Iraq from 3 May 2003 to 3 April 2004” entered in the Remarks section (block18) of his DD Form 214.   

2.  The applicant was awarded the CMB on 8 July 2003 and is also entitled to have that award entered on his DD Form 214 as well.

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing his award of the CMB and by entering in the REMARKS section “Service in Iraq from 3 May 2003 to 3 April 2004.” 

2.  The Board wants the applicant and all others to know that the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated.  The applicant and all Americans should be justifiably proud of his service in arms.
