IN THE CASE OF:
BOARD DATE: 26 June 2008
DOCKET NUMBER: AR20080001477
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his DD Form 214 be corrected to reflect his deployment to Iraq in support of Operation Iraqi Freedom during the period of 1 May 2003 to 30 April 2004 and his award of the Combat Medical Badge (CMB).
2. The applicant states, in effect, that the information regarding his deployment to Iraq in support of Operation Iraqi Freedom during the period of 1 May 2003 to 30 April 2004 and his award of the CMB were omitted from his DD Form 214 at the time of his discharge.
3. The applicant provides a copy of orders awarding him the CMB and a copy of his DD Form 214.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the pay grade of E-4 on 15 October 1997 for a period of 4 years and training as a medical specialist. He completed his training and was transferred to Fort Hood, Texas. He was promoted to the pay grade of E-5 on 1 May 2001.
2. On 3 May 2001, he reenlisted for a period of 4 years and assignment to Europe. He was transferred to Germany on 30 August 2001.
3. Information obtained from the Defense Finance and Accounting Service (DFAS) shows that the applicant arrived in Iraq on 3 May 2003 and departed on 3 April 2004. He was paid hostile fire pay for the period of 1 May 2003 through 30 April 2004, since hostile fire pay is a monthly entitlement.
4. Meanwhile, on 8 July 2003, Permanent Orders Number 189-72 issued by 2nd Brigade, 1st Armored Division Iraq, awarded the applicant the CMB.
5. The applicant departed Germany on 29 August 2004 and was transferred to Fort Jackson, South Carolina where he remained until he was honorably discharged due to completion of required service. His DD Form 214 issued at the time of his discharge fails to reflect the period he served in Iraq and his award of the CMB.
6. Army Regulation 635-5 serves as the authority for the preparation of the DD Form 214. It provides, in pertinent part, that an entry will be made in the REMARKS section of the DD Form 214 to reflect Service in (name of Country deployed) from and to dates.
DISCUSSION AND CONCLUSIONS:
1. The applicant served in Iraq from 3 May 2003 to 3 April 2004 in support of Operation Iraqi Freedom. Accordingly, he is entitled to have the entry Service in Iraq from 3 May 2003 to 3 April 2004 entered in the Remarks section (block18) of his DD Form 214.
2. The applicant was awarded the CMB on 8 July 2003 and is also entitled to have that award entered on his DD Form 214 as well.
BOARD VOTE:
__XXX __ __XXX__ __XXX__ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing his award of the CMB and by entering in the REMARKS section Service in Iraq from 3 May 2003 to 3 April 2004.
2. The Board wants the applicant and all others to know that the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated. The applicant and all Americans should be justifiably proud of his service in arms.

Patrick McGann | |Member | The Board considered the following evidence: Exhibit A - Application for correction of military records. Upon application, any such service member may be awarded the Afghanistan Campaign Medal in lieu of the GWOTEM for such service; however, no service member shall be entitled to award of the Afghanistan Campaign Medal and the GWOTEM for the same act, achievement or period of service. As a result, the Board recommends that all Department of the Army records of...

The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to add the Iraq Service Medal (assumed to be the Iraq Campaign Medal, or ICM), Global War on Terrorism Service Medal (GWOTSM), Global War on Terrorism Expeditionary Medal (GWOTEM), Combat Action Badge (CAB), Combat Medical Badge (CMB). The applicant served on active duty during a time which entitled him to the GWOTSM. Since there is no evidence that he was personally present and...

The narrative for award of the Bronze Star Medal shows he was personally present and under fire while performing duties during the Operation Iraqi Freedom. Therefore, there is insufficient evidence to grant the request for award of the CMB in this case. Records show the applicant was awarded the Army Commendation Medal.
ARMY | BCMR | CY2008 | 20080010022
The applicant states that he served in Iraq from January 2003 to August 2003 and should be entitled to correction of his records to show his foreign service and his award of the Iraq Campaign Medal. Army Regulation 600-8-22 (Military Awards) states that individuals authorized the Iraq Campaign Medal must have served in direct support of Operation Iraqi Freedom (OIF). The evidence of record shows that the applicant served a qualifying period for award of the Iraq Campaign Medal and is...

The applicant requests, in effect, correction of item 12f (Foreign Service), of his DD Form 214 (Certificate of Release or Discharge from Active Duty), to show the entry "0001 07 00" (1 year and 7 months) instead of the entry "0000 11 11" (11 months and 11 days) and award of the Meritorious Service Medal (MSM), and the Combat Medical Badge (CMB). The evidence of record shows that the applicant was ordered to active duty on 7 September 2004, with a reporting date of 10 September 2004, not to...

He remained at Fort Hood until he was honorably discharged on 18 May 2006; however, his DD Form 214 issued at the time of his discharge does not reflect his service in Iraq. The applicant has provided sufficient evidence to establish that he was deployed to Iraq in support of Operation Iraqi Freedom during the period of 25 November 2005 to 13 March 2006 (3 months and 18 days). As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected...

On 22 February 2008, the applicant was awarded the MSM for the period of 1 August 1998 to 31 July 2008. Although there is no evidence in his OMPF to indicate exactly what dates the applicant served in Iraq, records show that the applicant was awarded the BSM for his service in Iraq from 20 August 2005 to 20 February 2006. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing that he was awarded the MSM (4th award) and...

The applicant requests that his deployment to Kuwait and Baghdad, Iraq, two Army Achievement Medals, one Overseas Service Ribbon, the Army Commendation Medal, the Driver Badge and the Combat Action Badge be included on his Certificate of Release or Discharge from Active Duty (DD Form 214).
