The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show his service in Iraq and his prior active and inactive service.

2. The applicant states, in effect, that Item 12 (Record of Service) of his
DD Form 214 does not show his service in Iraq or his prior active and inactive service.

3. The applicant provides a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. At the time of his application, the applicant was a member of the United States Army Reserve.

2. Orders M-023-0036, 77th Regional Support Command, dated 23 January 2003, ordered the applicant to active duty as a Reserve Component member of the 623rd Transportation Company, effective 24 January 2003, for the purpose of mobilization in support of Operation Enduring Freedom.

3. On 13 February 2003, the applicant entered active duty as a Reserve Soldier. His military occupational specialty was 92G (Food Service Specialist). On
12 August 2003, the applicant was released from active duty. He had completed 6 months of creditable active duty service during this period.

4. Item 12 (Record of Service) of the applicant’s DD Form 214 shows that he completed 6 months of active duty service but that none of it was served overseas. It refers the reader to Item 18 (Remarks) regarding his prior active and inactive service. The remarks block states that he was separated on temporary records and that a DD Form 215 (Correction to DD Form 214) would have to be issued to record his prior service data. There is no mention in the remarks block regarding any overseas service.

5. A staff member of the Board verified through the Defense Finance and Accounting Service (DFAS) that the applicant’s military pay record for the period from 13 February to 12 August 2003 does not show that he served in any area that authorized him to receive hazardous duty pay or imminent danger pay.

DISCUSSION AND CONCLUSIONS:

1. The available evidence clearly shows that the applicant’s unit was mobilized in support of Operation Enduring Freedom. However, it does not show that he was deployed outside of the United States.

2. The available evidence is insufficient to determine the applicant’s prior active and inactive service; hence, a DD Form 215 cannot be properly issued.

3. In view of the above, the applicant’s request should be denied.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

___X____ ____X____ ___X _ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.
