IN THE CASE OF:
BOARD DATE: 20 May 2008
DOCKET NUMBER: AR20070012945
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests reconsideration of his earlier request for award of the Purple Heart for wounds received during World War II.
2. The applicant states, in effect, that he and a comrade were assigned as replacement personnel to the Anti-Tank Company, 34th Infantry Regiment,
24th Infantry Division. They had not seen each other until their meeting in the applicant's hometown 2 years ago.
3. The applicant provides a statement from his comrade dated 20 August 2007.
CONSIDERATION OF EVIDENCE:
1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20070000589, on 14 August 2007.
2. The statement provided by the applicant's comrade is new evidence.
3. On 20 August 2007, the applicant's comrade stated that because of the amount of time that has past, he cannot recall exact dates. He further states that he does remember that the applicant reported back to their unit upon being released from the hospital. To the best of his recollection, the applicant returned to duty shortly before hostilities had ended which was soon after they had begun preparing for the invasion of Japan.
DISCUSSION AND CONCLUSIONS:
The statement by the applicant's comrade clearly shows that the applicant had been hospitalized and was returned to duty. However, it does not provide any details showing how the applicant became injured or wounded, or if his injuries or wounds were the result of enemy action. Therefore, the applicant's request should be denied.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
___X____ ___X____ ____X___ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20070000589, dated 14 August 2007.

The applicant requests he be awarded the Purple Heart and that it be added to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). There are no orders awarding the applicant the Purple Heart and his records do not contain evidence that he was ever wounded in action. While the Board does not question the sincerity of these statements, by themselves and without corroborating evidence, they are insufficient to establish entitlement to award of the Purple Heart.

The applicant's elected representative's contention that regulations in effect at the time of the incident were not cited by the Board and that the applicant's BSM for heroism proves that the Board was in error in its conclusion are new arguments and require that the Board reconsider the applicant's request. In its first consideration of this case, the Board concluded that the evidence of record clearly shows that the applicant suffered from a recurring hernia and was sent for medical...

There is no conclusive evidence to show that the applicant was wounded in action. Consequently, the applicant’s records should be corrected to show that he was wounded in action on Cebu on 2 May 1945. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing that he was wounded in action on Cebu Island in the Philippines on 2 May 1945, by award of the Purple Heart, the Bronze Star Medal, the Asiatic-Pacific Campaign Medal...

The applicant requests award of the Purple Heart. The applicant requests award of the Purple Heart. The evidence supporting denial of the applicant's request includes: * no medical records providing details of his wounding * no orders in his MPRJ awarding him the Purple Heart * no Purple Heart orders in ADCARS * the discrepancy in the date of wounding between applicant's statements and his DA Form 20 4.

The FSM's military records are not available to the Board for review. The review failed to show that the FSM was entitled to award of the Purple Heart. The Unit Citation and Campaign Participation Credit Register shows that the 112th Infantry Regiment participated in five campaigns during World War II, three prior to the FSM's hospitalization in November 1944 – Normandy, Northern France, and the Rhineland.
