THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his military records to show award of the Armed Forces Expeditionary Medal and the Korean Defense Service Medal.
2. The applicant states that he received these awards but they were not added to his Armed Forces of the United States Report of Transfer or Discharge
(DD Form 214).
3. The applicant provides a copy of his DD Form 214, and information sheets showing the criteria for the requested awards.
CONSIDERATION OF EVIDENCE:
1. The applicant is requesting correction of an alleged error or injustice which occurred on 21 August 1968, the date of his release from active duty. The application submitted in this case is dated 11 January 2007.
2. Title 10, U.S. Code, Section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law allows the Army Board for Correction of Military Records (ABCMR) to excuse failure to file within the 3-year statute of limitations if the ABCMR determines that it would be in the interest of justice to do so. In this case, the ABCMR will conduct a review of the merits of the case to determine if it would be in the interest of justice to excuse the applicants failure to timely file.
3. On 21 November 1966, the applicant was inducted into the Army of the United States for 2 years. He completed his initial training and was awarded military occupational specialty 64A1O (Light Vehicle Driver).
4. On 21 April 1967, the applicant was assigned for duty as a light vehicle driver with the Headquarters, 2nd Infantry Division, in the Republic of Korea.
5. On 29 September, 1967, the applicant was reclassified into MOS 11F2O (Infantry Operations and Intelligence Specialist) and assigned as an intelligence assistant with the Headquarters, 2nd Infantry Division.
6. On 19 August 1968, the applicant was returned to the United States. He had served in the Republic of Korea for 16 months.
7. On 21 August 1968, the applicant was released from active duty. He had attained the rank of specialist five, pay grade E5 and had completed 1 year and
9 months of creditable active duty.
8. Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 lists his awards as the National Defense Service Medal and the Expert Marksmanship Qualification Badge with Rifle Bar. It does not show award of the Armed Forces Expeditionary Medal.
9. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, for award of the Armed Forces Expeditionary Medal for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance to friendly foreign nations. Qualifications for this award includes the requirements to be a bona fide member in a unit engaged in the operation or to serve in the area of operations for 30 days, or to be engaged in direct support of the operation for 30 consecutive or 60 nonconsecutive days provided this support involves entering the area of operations. The regulation also provides that the Armed Forces Expeditionary Medal may be awarded if the individual served the full period in cases when the operation is less than 30 days in duration, if the individual is engaged in actual combat with armed opposition regardless of the period of service, if the individual participates as a member of an aircraft flying in support of the operation, or if the individual is recommended (or attached to a unit recommended) for award of the medal if the above criteria have not been met. This regulation further provides that service in the Republic of Korea between 1 October 1966 and 30 June 1974, qualifies for award of this medal.
10. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, for award of the Korean Defense Service Medal. This message specified criteria for the award of the Korean Defense Service Medal as follows: a) service members of the armed forces must have served in support of the defense of the Republic of South Korea from 28 July 1954 through a future date to be determined by the Secretary of Defense; b) the area of eligibility encompasses all land area of the Republic of South Korea, and the contiguous water out to 12 nautical miles, and all air spaces above the land and water areas; c) service members must have been mobilized with units or assigned or attached to units operating in the area of eligibility for 30 consecutive or 60 non-consecutive days.
11. Review of the applicant's records indicates entitlement to additional awards and decorations that are not shown on his DD Form 214.
12. Item 38 (Record of Assignments) of the applicant's Enlisted Qualification Record (DA Form 20) shows that his conduct and efficiency were excellent. Further review of his records failed to reveal any adverse disciplinary action or evidence of the commander denying him award of the Army Good Conduct Medal.
13. Army Regulation 672-5-1, in effect at the time, provides that the Army Good Conduct Medal is awarded to individuals who have completed a qualified period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. The enlisted person must have had all "excellent" conduct and efficiency ratings and no convictions by a court-martial. Ratings of "Unknown" for
portions of the period under consideration are not disqualifying. Service and efficiency ratings based upon academic proficiency of at least "Good" rendered subsequent to 22 November 1955 are not disqualifying.
DISCUSSION AND CONCLUSIONS:
1. Records show that the applicant served in the Republic of Korea during a qualifying period for award of the Armed Forces Expeditionary Medal and the Korean Defense Service Medal. Therefore, his records should be corrected to show these awards.
2. The applicants records clearly show that he distinguished himself in the performance of his military service. Therefore, it is presumed that his not receiving an Army Good Conduct Medal for his service was an oversight. Accordingly, he should be awarded this medal.
3. Records show the applicant should have discovered the alleged error or injustice now under consideration on 21 August 1968; therefore, the time for the applicant to file a request for correction of any error or injustice expired on
20 August 1971. The applicant did not file within the 3-year statute of limitations; however, based on the available evidence or argument, it would be in the interest of justice to excuse failure to timely file in this case.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief and to excuse failure to timely file. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. awarding him the Army Good Conduct Medal for the period from
21 November 1966 to 21 August 1968; and
b. showing that, in addition to the awards shown on his DD Form 214, his authorized awards include the Army Good Conduct Medal, Armed Forces Expeditionary Medal and the Korean Defense Service Medal.
