	The Board considered the following evidence:

	Exhibit A - Application for correction of military records.

	Exhibit B - Military Personnel Records (including advisory opinion, if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his records to show award of the Overseas Service Ribbon.

2.  The applicant states, in effect, that he served overseas in Iraq from November 2005 to November 2006, was awarded the Iraq Campaign Medal, and is entitled to award of the Overseas Service Ribbon.

3.  The applicant provides a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty), with an effective date of 17 December 2006.

CONSIDERATION OF EVIDENCE:

1.  The applicant's military service records show that he enlisted in the Army National Guard on 12 April 1986.  Upon completion of basic combat training and advanced individual training, the applicant was awarded military occupational specialty (MOS) 76Y (Unit Supply Specialist).  The applicant's military service records show that he was ordered to active duty on 1 May 1988 for a 3-year Active Guard/Reserve (AGR) tour.  

2.  The applicant's military service records contain a DD Form 214, with an effective date of 7 August 1993.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) shows, in pertinent part, that he was awarded the National Defense Service Medal.  This document also shows that the applicant was honorably released from active duty (REFRAD) on 7 August 1993 and transferred to the California ARNG after completing 5 years, 3 months, and 7 days net active service.

3.  The applicant's military service records contain a NGB Form 22 (Report of Separation and Record of Service), with an effective date of 30 October 1996, which shows the applicant was transferred to the U.S. Army Reserve (USAR) Control Group for unsatisfactory participation.  Item 12 (Military Education) shows that he completed the Administrative Unit Supply Course in February 1989 and the Primary Leadership Development Course in February 1994.  Item 13 (Primary Specialty Number, Title, and Date Awarded) shows that the applicant’s MOS was redesignated MOS 92Y (Unit Supply) on 1 October 1992.  Item 15 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded This Period) shows, in pertinent part, that he was awarded the National Defense Service Medal and Army Service Ribbon.

4.  The applicant's military service records contain a DD Form 214, with an effective date of 17 December 2006.  This document shows that the applicant was ordered to active duty in support of Operation Iraqi Freedom on 18 August 2005 and served in Iraq from 27 November 2005 to 11 November 2006.  Item
13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) shows that he was awarded the National Defense Service Medal, Global War on Terrorism Service Medal, Iraq Campaign Medal, Army Service Ribbon, and Armed Forces Reserve Medal with “M” Device.  Item 18 (Remarks) shows, in pertinent part, that he was awarded 2 Overseas Bars.  This document also shows that the applicant was honorably REFRAD on 17 December 2006 and transferred to the Washington ARNG after completing 1 year and 4 months net active service during this period and 11 months and 15 days foreign service.

5.  A review of the applicant's military service records reveals that he may be entitled to additional awards that are not shown on his DD Form 214.

6.  The applicant’s military service records contain a copy of a DA Form 638 (Recommendation for Award), dated 22 June 2006.  This document shows, in pertinent part, that Headquarters, 43rd Military Police Brigade (Iraq), Permanent Order Number 193-013, dated 11 July 2006, awarded the applicant the Army Commendation Medal for meritorious service in support of Operation Iraqi Freedom from 18 August 2005 to 15 November 2006.

7.  Army Regulation 600-8-22 (Military Awards) provides that the Army Commendation Medal may be awarded to any member of the Armed Forces of the United States who, while serving in any capacity with the Army after 6 December 1941, distinguished himself or herself by heroism, meritorious achievement or meritorious service.  As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.

8.  Army Regulation 600-8-22, as amended, provides that the National Defense Service Medal is awarded for honorable active service for any period between
27 July 1950 through 27 July 1954, 1 January 1961 through 14 August 1974, 2 August 1990 through 30 November 1995, and 11 September 2001 to a date to be determined.

9.  Army Regulation 600-8-22 also provides that each subsequent award of the National Defense Service Medal is denoted by a bronze service star affixed to the National Defense Service Medal.

10.  Army Regulation 600-8-22 shows that the Noncommissioned Officer (NCO) Professional Development Ribbon was established by the Secretary of the Army on 10 April 1981.  It is awarded to Active Army, Army National Guard, and USAR Soldiers for successful completion of designated NCO professional development courses.  The regulation governing this award also provides, in pertinent part, that graduates of the Primary Leadership Development Course will be awarded the basic ribbon.

11.  Army Regulation 600-8-22 shows that the Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981.  The regulation states, in pertinent part, that effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award upon successful completion of overseas tours.  The award may be awarded retroactively to those personnel who were credited with a normal overseas tour completed before 1 August 1981, provided they had an Active Army status on or after 1 August 1981.  On 25 October 2005, the policy that restricted award of the Overseas Service Ribbon when another campaign or service medal is awarded was eliminated, provided the individual was credited with normal tour completion for the overseas tour location.

12.  Army Regulation 614-30 (Overseas Service) prescribes the policies related to overseas permanent change of station moves.  This regulation also governs overseas tour lengths and credit for normal tour completion.  The normal overseas tour length for service in Iraq is 12 months.

13.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army.  It also establishes standardized policy for preparing and distributing the DD Form 214.  Chapter 2 contains guidance on the preparation of the DD Form 214.  It states, in pertinent part, that the source documents for entering information on the DD Form 214 will be the Personnel Qualification Record (PQR), Enlisted/Officer Record Brief (ERB/ORB), or any other document authorized for filing in the Military Personnel Records Jacket (MPRJ) or Official Military Personnel File (OMPF).

14.  Paragraph 2-4 (Completing the DD Form 214) of the Separation Documents regulation contains item-by-item instructions for completing the DD Form 214. The instructions for Item 13 state to list awards and decorations for all periods of service in the priority sequence specified in AR 600-8-22.  Each entry will be verified by the Soldier's records.


DISCUSSION AND CONCLUSIONS:

1.  The applicant contends, in effect, that his records should be corrected to show award of the Overseas Service Ribbon because he served in Iraq from November 2005 to November 2006.

2.  The evidence of record shows the applicant was credited with the completion of an overseas (12-month) tour in Iraq.  The evidence of record also shows that the policy that restricted award of the Overseas Service Ribbon when another campaign or service medal (e.g., the Iraq Campaign Medal) is awarded was eliminated on 25 October 2005.  Therefore, the applicant is entitled to correction of his records to show award of the Overseas Service Ribbon.

3.  Permanent Orders awarded the applicant the Army Commendation Medal. Therefore, he is entitled to correction of his records to show this award.

4.  The evidence of record shows that the applicant was awarded the National Defense Service Medal for his honorable active service during the period
2 August 1990 through 7 August 1993.  The evidence of record also shows that the applicant is entitled to a second award of the National Defense Service Medal for his honorable active service during the period 18 August 2005 through
17 December 2006.  Therefore, the applicant is entitled to correction of his records to show award of the National Defense Service Medal with 1 bronze service star.

5.  The evidence of record shows that the applicant is entitled to award of the Noncommissioned Officer Professional Development Ribbon (NCOPDR) based on completion of the Primary Leadership Development Course.  Therefore, he is entitled to correction of his records to show award of the NCOPDR.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting from his DD Form 214 (with an effective date of 17 December 2006) the National Defense Service Medal; and


	b.  adding to his DD Form 214 (with an effective date of 17 December 2006) the Army Commendation Medal, National Defense Service Medal with
1 bronze service star, Overseas Service Ribbon, and Noncommissioned Officer Professional Development Ribbon.
