Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that he be paid the enlistment bonus he was
promised.
2. The applicant states that his recruiter told him he would receive an
enlistment bonus if he enlisted in an infantryman (11B1O) military
occupational specialty (MOS).
3. The applicant provides no additional documentation in support of his
application.
CONSIDERATION OF EVIDENCE:
1. On 26 June 2002, he enlisted in the United States Army Reserve (USAR)
under the Delayed Entry/Enlistment Program (DEP), in Mechanicsburg,
Pennsylvania, for 8 years, in the pay grade of E-1. At the time of his
USAR enlistment he signed a Statement for Enlistment, United States Army
Enlistment Program, United States Army Delayed Enlistment Program form
which shows his enlistment for the U. S. Training Enlistment Program option
of infantry recruit, Career Management Field (CMF 11). On the form he
acknowledged that he was qualified and that he was enlisting for an MOS or
CMF that had no cash bonus.
2. He enlisted in the Regular Army (RA) for 3 years on 20 June 2003 and
the Enlistment/Reenlistment Document, Armed Forces of the United States,
which he signed, fails to show that he was promised an enlistment bonus at
the time of his RA enlistment. His records show that he went on to
successfully complete his 11B1O MOS training.
3. On 19 June 2006, at the completion of his required active duty service,
the applicant was released from active duty and transferred to the USAR
Control Group (Reinforcement) to complete his Reserve obligation.
4. Army Regulation 601-210 provides in pertinent part, policies and
instructions on the administration of the enlistment bonus program. The
incentive prescribed for a selected MOS will be announced by message.
Enlistment incentives are offered to those enlisting for a specific MOS.
The MOS’s are adjusted periodically to meet the manpower needs of the Army.
Additions to and deletions from the list of incentives for specific MOS
vacancies are made. To be eligible
for an enlistment incentive, an enlistee must meet qualification
requirements and successfully complete advanced or one station unit
training and be awarded the MOS for which enlisted. If a Soldier, through
no fault of his own, is disqualified from or fails to complete training in
the MOS for which enlisted for an incentive, he will have the option to
continue the current enlistment and to select another bonus MOS for
training, and on satisfactory completion of training and award of the MOS,
be entitled to the bonus for that MOS; or to select training where space is
available in any nonbonus MOS for which qualified and complete the term of
enlistment for the MOS selected. No bonus is granted in this case.
Entitlement to the incentive is contingent on successful completion of
training and award of a designated MOS. A Soldier is entitled to the
incentive in effect on the date of initial contract in the DEP.
DISCUSSION AND CONCLUSIONS:
1. There is no evidence in the available record, nor has the applicant
submitted any evidence, to support his contention that his recruiter
promised him an enlistment bonus at the time of his enlistment.
2. The available records indicate that he was aware he was enlisting for
an MOS that had no cash bonus. At the time that he enlisted, he signed a
Statement of Understanding acknowledging that he understood that he was not
entitled to an enlistment bonus. The evidence of record indicates that the
applicant was not entitled to an enlistment bonus.
3. In order to justify correction of a military record the applicant must
show or it must otherwise satisfactorily appear, that the record is in
error or unjust. The applicant has failed to submit evidence that would
satisfy this requirement.
4. In view of the foregoing, there is no basis for granting the
applicant's request.

BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.
