      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that he be awarded additional constructive
credit for his Master of Business Administration (MBA) degree.

2.  The applicant states his current rank and grade do not account for his
MBA, earned in 1996.

3.  The applicant provides a copy of his MBA; his undergraduate college
transcripts; his U. S. Army Recruiting Command Form 1131 (Department of the
Army Service Agreement F. Edward Hebert Armed Forces Health Professions
Scholarship Program (AFHPSP)); his Medical School matriculation letter; his
appointment orders; two oaths of office; and his active duty orders.

CONSIDERATION OF EVIDENCE:

1.  The applicant earned his MBA in Business Administration on 12 May 1996.

2.  On 19 July 2003, the applicant signed his AFHPSP contract and began
medical school.  He was granted his medical degree on 14 May 2006.  On
  14 May 2006, he was commissioned a Medical Corps captain in the U. S.
Army Reserve with a specialty of 61F (Internist).  He was awarded four
years of constructive credit.

3.  The applicant entered active duty on 1 June 2006.  His active duty
orders show he was awarded six years of constructive credit, and he was
given an active date of rank of 1 June 2004.  The basis of the additional
two years of constructive credit cannot be determined.

4.  In the processing of this case, an advisory opinion was obtained from
the Graduate Medical Education Division, Office of The Surgeon General.
That office stated Department of Defense Directive (sic) 6000.13 is the
governing directive in granting constructive credit.  In accordance with
paragraph 6.1.2.2.2.2. of this directive, the degree must be in a health
profession other than medicine and dentistry.  Also, paragraph 6.1.2.2.3.
states the additional degree must add adjunctive skills to the primary
specialty and must contribute directly to performance in the anticipated
position in the Military Service concerned.  That office stated the
applicant’s MBA does not meet either of these criteria for credit and
therefore recommended no additional credit for his MBA be awarded.

5.  A copy of the advisory opinion was provided to the applicant for
comment or rebuttal.  He did not respond within the given time frame.

6.  DOD Instruction (DODI) 6000.13 (Medical Manpower and Personnel)
implements policy, assigns responsibilities, and prescribes procedures to
carry out medical manpower and personnel programs.  Paragraph 6.1. states
the entry grade credit to be awarded shall equal the sum of constructive
service credit and prior commissioned service (as outlined in the DODI)
credit except in cases where the total exceeds the maximum credit allowed.
A period of time shall be counted only once when computing entry grade
credit.

7.  DODI 6000.13, paragraph 6.1.2.2.1. states four years of constructive
service credit shall be granted for completion of first professional
degrees that include medical (M.D.), osteopathy (D.O.), dental (D.D.S. or
D.M.D.), optometry (O.D.), podiatry (Pod.D. or D.P), veterinary (D.V.M.)
and pharmacy (Ph.D.).

8.  DoDI 6000.13, paragraph 6.1.2.2.2. states credit for master's and
doctorate degrees in a health profession other than medicine and dentistry,
whether it is the primary degree or an additional advanced degree, shall be
awarded based on actual full-time equivalent education up to two years for
a master's degree and up to four years for a doctorate.  Paragraph
6.1.2.2.3. states the additional degree must add adjunctive skills to the
primary specialty and must contribute directly to performance in the
anticipated position in the Military Service concerned.

DISCUSSION AND CONCLUSIONS:

1.  In order for a master’s degree to be eligible for additional
constructive credit, DoDI 6000.13, paragraph 6.1.2.2.2. requires the degree
to be in a health profession other than medicine and dentistry.  Paragraph
6.1.2.2.3. requires the additional degree to add adjunctive skills to the
primary specialty and contribute directly to performance in the anticipated
position in the Military Service concerned.

2.  The applicant’s MBA was in Business Administration, and he was
commissioned a Medical Corps captain in the U. S. Army Reserve with a
specialty of 61F.  His master’s degree was not in a health profession;
therefore, it did not meet the primary requirement to be eligible for
additional constructive credit.

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable
error or injustice.  Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.
