THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, the awards of the Global War on Terrorism Expeditionary Medal, the National Defense Service Medal with one bronze service star, the Overseas Service Ribbon with numeral 2, and the Driver and Mechanic Badge be entered on his DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of  7 November 2004.

2.  The applicant states, in effect, the awards of the National Defense Service Medal with one bronze service star, the Overseas Service Ribbon with numeral 2, and the Driver and Mechanic Badge were listed on a previous DD Form 214 and that he has not received the Global War on Terrorism Expeditionary Medal.

3.  The applicant provides excerpts from his military personnel records.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 22 November 1995 for a period of 3 years.  The applicant reenlisted on 2 October 1998.

2.  The applicant’s DA Form 2-1 (Personnel Qualification Record) shows the applicant completed two overseas tours in Bosnia and that he was awarded the Driver and Mechanic Badge.

4.  The applicant was discharged on 1 October 2002 due to his completion of  required active service.  Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s 
DD Form 214 with a separation date of 1 October 2002 included the following entries: “National Defense Service Medal (2nd award), Overseas Service Ribbon (w/NUM 2), and the Driver and Mechanic Badge.

5.  The applicant enlisted in the U.S. Army Reserve (USAR) and on 
24 November 2003, he was ordered to active duty in support of Operation Enduring Freedom and Operation Iraqi Freedom.  The applicant was deployed 
to Kuwait from 6 February 2004 to 14 July 2004.

6.  On 7 November 2004, the applicant was discharged due to disability with severance pay.  Item 13 of the applicant’s DD Form 214 with a separation date of 7 November 2004 did not include entries for the Global War on Terrorism Expeditionary Medal, the National Defense Service Medal with one bronze service star, the Overseas Service Ribbon with numeral 2, and the Driver and Mechanic Badge.

7.  Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, Award of the Global War on Terrorism Service Medal is authorized to soldiers who have participated in, or served in support of, Global War on Terrorism operations outside of the designated area of operations. Initial award of the Global War on Terrorism Service Medal will be limited to airport security operations (from 27 September 2001 through 31 May 2002) and soldiers who supported Operations Noble Eagle, Enduring Freedom, and Iraqi Freedom.  All Soldiers on active duty, including Reserve Component Soldiers mobilized, or National Guard Soldiers activated on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal. 

8.  Initial award of the Global War on Terrorism Expeditionary Medal is limited to soldiers deployed abroad in operations Enduring Freedom and Iraqi Freedom in the following Department of Defense designated specific geographic areas of eligibility: Afghanistan, Bahrain, Bulgaria (Bourgas), Crete, Cyprus, Diego Garcia, Djibouti, Egypt, Eritrea, Ethiopia, Iran, Iraq, Israel, Jordan, Kazakhstan, Kenya, Kuwait, Kyrgyzstan, Lebanon, Pakistan, Philippines, Qatar, Romania (Constantan), Saudi Arabia, Somalia, Syria, Tajikistan, Turkey (east of 35 degrees east latitude) Turkmenistan, United Arab Emirates, Uzbekistan, Yemen, that portion of the Arabian Sea north of 10 degrees north latitude and west of 68 degrees longitude, Bab El Mandeb, Gulf of Aden, Gulf of Aqaba, Gulf of Oman, Gulf of Suez, that portion of the Mediterranean Sea east of 28 degrees east longitude, Persian Gulf, Red Sea, Strait of Hormuz, and Suez Canal.  To be eligible for the Global War on Terrorism Expeditionary Medal a soldier must be assigned, attached, or mobilized to a unit participating in designated operations for 30 consecutive days or 60 nonconsecutive days.

9.  Army Regulation 600-8-22 provides, in pertinent part, that the National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 through 27 July 1954, 1 January 1961 through 
14 August 1974, 2 August 1990 through 30 November 1995 and 11 September 2001 to a date to be determined.  The regulation provides that a bronze service star affixed to the service ribbon denotes the second award of the National Defense Service Medal.

10.  Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214.  In pertinent part, it stated that all decorations, service medals, campaign credits, and badges awarded or authorized will be entered in Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized).

DISCUSSION AND CONCLUSIONS:

1.  The evidence shows the applicant is entitled to the award of the Global War on Terrorism Expeditionary Medal.

2.  The evidence shows the applicant is entitled to the National Defense Service Medal with one bronze service star, the Overseas Service Ribbon with 
numeral 2, and the Driver and Mechanic Badge.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing the applicant was awarded the Global War on Terrorism Expeditionary Medal.

2.  The Board further recommends that Item 13 of the applicant’s DD Form 214 with a separation date of 7 November 2004 be amended to include the following awards:  the National Defense Service Medal with one bronze service star, the Overseas Service Ribbon with numeral 2, and the Driver and Mechanic Badge.
