      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

 THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the awards and military
occupational specialty (MOS) listed on his Certificates of Release or
Discharge from Active Duty (DD Forms 214) be corrected.

2.  The applicant states that he was awarded a third award of the Army
Achievement Medal, and a Joint Service Commendation Medal and MOS 11B10B4
and is entitled to an Arrowhead Device for wear on the Global War on
Terrorism Expeditionary Medal.

3.  The applicant provides a Headquarters, 3rd Infantry Regiment DA Form
638, (Recommendation for Award), and a certificate for award of the AAM;
Order Number 653, published by the Multi-National Security Transition
Command- Iraq (MNSTC-I), dated 15 August 2005 and a certificate for award
of the Joint Service Commendation Medal; Permanent Orders 145-1,
Headquarters 173 Airborne Brigade, dated 24 May 2004 for award of the
Parachutist Badge with Bronze Star; Orders Number 159-1776, Headquarters,
United States Army Infantry Center, dated 7 June 2004; a Certificate of
Achievement, dated 26 August 2003; and a DD Forms 214 for the period from
14 September 2004 through 8 October 2005.

CONSIDERATION OF EVIDENCE:

1.  The applicant, currently a United States Army Reserve (USAR) sergeant
previously served on active duty in the Regular Army from May 1977 to June
2004.  He was released from active duty and transferred to a USAR unit in
Lewiston, Maine.

2.  The applicant was awarded the Army Achievement Medal for meritorious
achievement during the period 1 April through 6 May 1998 by Headquarters,
3rd Infantry Regiment and for meritorious achievement on 12 August 1998 by
the same headquarters.  Headquarters, 3rd Infantry Regiment also awarded
him a third Army Achievement Medal.  This one was for meritorious service
for the period 13 September to 20 March 2000.

3.  Permanent Orders 145-1, Headquarters 173rd Airborne Brigade, dated
24 May 2004, awarded the applicant a bronze service star for wear on the
Parachutist Badge, “For participation in a combat jump into enemy held
territory in support of Operation Iraqi Freedom.”

4.  Headquarters United States Army Infantry Center and Fort Benning,
Georgia orders number 159-1776, dated 7 June 2004 awarded the applicant
Primary MOS 11B10B4 and withdrew MOS 11B10.

5.  The awards listed on his 24 June 2004 DD Form 214 include the Army
Commendation Medal, the Army Achievement Medal (2nd Award), the Good
Conduct Medal, the National Defense Service Medal, the Army Service Ribbon.
The Army Overseas Service Medal, the Combat Infantryman Badge, the
Parachutist Badge, the Global War on Terrorism Service Medal, and the
Hungarian Parachutist badge.

6.  The applicant was mobilized as a member of the USAR on 14 September
2004 and served in Iraq for over 10 months.

7.  Award Order MNSTC-I Number 653, dated 15 August 2005, published by the
Multi-National Security Transition Command – Iraq, awarded the applicant
the Joint Service Commendation Medal for the period 17 October 2004 through
31 August 2005.

8.    The awards listed on his 24 June 2004 DD Form 214 include the Army
Commendation Medal, the Army Achievement Medal (2nd Award), the Good
Conduct Medal, the National Defense Service Medal, the Army Service Ribbon.
the Army Overseas Service Medal, the Armed Forces Reserve Medal with “M”
Device, the Combat Infantryman Badge, the Parachutist Badge, the Global War
on Terrorism Service Medal, and the Iraq Service Medal.

9.  Human Resources Command Message (Date Time Group 17 March 2004)
disseminated implementing instructions for award of the Global War on
Terrorism Service Medal.  This award is designated for Soldiers who have
participated in or served in support of Global War on Terrorism Operations
outside of the designated area of eligibility determined for award of the
Global War on Terrorism Expeditionary Medal on or after 11 September 2001
to a date to be determined.  All Soldiers on active duty, including Reserve
Component Soldiers mobilized or National Guard Soldiers activated, on or
after 11 September 2001 to a date to be determined having served 30
consecutive days or 60 nonconsecutive days are authorized this award.

10.  Soldiers may receive both the Global War on Terrorism Service Medal
and the Global War on Terrorism Expeditionary Medal if they meet the
requirements of both awards; however, the same period of service
establishing one cannot be used to justify service eligibility for the
other.

11.  The Human Resources Command Message (Date Time Group 17 March 2004)
limited initial award of the Global War on Terrorism Expeditionary Medal to
Soldiers who deployed abroad in Operations Enduring Freedom and Iraqi
Freedom in the following areas of eligibility (AOE):  Afghanistan, Bahrain,
Bulgaria (Bourgas), Crete, Cyprus, Diego Garcia, Djibouti, Egypt, Eritrea,
Ethiopia, Iran, Iraq, Israel, Jordan, Kazakhstan, Kenya, Kuwait,
Kyrgyzstan, Lebanon, Oman, Pakistan, Philippines, Qatar, Romania
(Constanta), Saudi Arabia, Somalia, Syria, Tajikistan, Turkey (east of 35
east degrees east latitude), Turkmenistan, United Arab Emirates,
Uzbekistan, Yemen, that portion of the Arabian Sea north of 10 degrees
north latitude and west of 68 degrees longitude, Bab El Mandeb, Gulf of
Aden, Gulf of Aqaba, Gulf of Oman, Gulf of Suez, that portion of the
Mediterranean Sea east of 28 degrees east longitude, Persian Gulf, Red Sea,
Strait of Hormuz, and Suez Canal.

12.  Military Awards Branch Message [dated 8 April 2005] provided the
following implementing instructions for award of the Iraq Campaign Medal.
Award of the Iraq Campaign Medal is authorized for service in direct
support of Operation Iraqi Freedom on or after 19 March 2003 to a future
date to be determined by the Secretary of Defense or the cessation of the
operation.  The area of eligibility encompasses all land area of the
country of Iraq and the contiguous sea area out to 12 nautical miles and
the air space above these areas.  To qualify for award of this campaign
medal, service members must have been assigned or attached to or mobilized
with units operating in these areas of eligibility for 30 consecutive days
or for 60 non-consecutive days or meet one of the following criteria:  a)
be engaged in combat during an armed engagement, regardless of the time in
the area of eligibility; b) be medically evacuated from the area of
eligibility for wounds or injuries resulting from participation in an
operation or official duties; or c)  participates as a regularly assigned
air crewmember flying sorties into, out of, within or over the area of
eligibility in direct support of the military operations [each day of
operations counts as one day of eligibility].  This campaign medal may be
awarded posthumously.

13.  Only one award of the Iraq Campaign Medal may be authorized for any
individual.  Service stars are not prescribed for wear with this medal;
however, the Iraq Campaign Medal may be awarded with the bronze arrowhead
device to eligible Soldiers.  Effective 30 April 2005, the Global War on
Terrorism Expeditionary Medal (GWOTEM) is no longer authorized to be
awarded for service in Iraq; however, service members who qualified for the
GWOTEM by reason of service between 19 March 2003 and 30 April 2005 in an
area for which the Iraq Campaign Medal was subsequently authorized shall
remain qualified for the GWOTEM.  Upon application, any such service member
may be awarded the Iraq Campaign Medal in lieu of the GWOTEM for such
service; however, no service member shall be entitled to award of the Iraq
Campaign Medal and the GWOTEM for the same act, achievement or period of
service.

14.  Army Regulation 600-8-22 (Military Awards) provides, in pertinent
part, for the “arrowhead” to be worn on the appropriate service medal to
denote participation in a combat parachute jump, helicopter assault
landing, combat glider landing, or amphibious assault landing while
assigned or attached as a member of an organized force carrying out an
assigned tactical mission.  The regulation specifies that individual
assault credit is tied directly to the combat assault credit decision for
the unit to which the Soldier is assigned.  The regulation requires that
the unit must be credited with a combat assault in order for the Soldiers
to receive credit for a combat assault and the Soldier must physically exit
the aircraft or the watercraft as appropriate.

DISCUSSION AND CONCLUSIONS:

1.  The orders for the Army Achievement Medal that the applicant submitted
actually apply to his second award.  Nevertheless, he was authorized three
awards of the Army Achievement Medal during his first period on active
duty.  They should be shown on both DD Forms 214 as the Army Achievement
Medal with 2nd Oak Leaf Cluster.

2.  The applicant was awarded the Parachutist Badge with one bronze service
star for a combat jump into Iraq.  This should be shown on Both DD Forms
214.

3.  By his service in Iraq, the applicant qualified for award of the Global
War on Terrorism Expeditionary Medal during his first period of active
duty.  By making a combat parachute jump into enemy held territory on 26
March 2003, the applicant qualified for award of the Bronze Arrowhead
Device for wear on the Global War on Terrorism Expeditionary Medal.  It
should be shown as such on both DD Forms 214.

4.  The applicant was awarded the Joint Service Commendation Medal for the
period 17 October 2004 through 31 August 2005.  It should be shown on his
second DD Form 214.

5.  Just 14 days before the end of his first period of active duty the
applicant was awarded Primary MOS 10B10B4 and his old MOS 11B10P was
withdrawn.  His correct MOS should be shown on his second DD Form 214.

6.  The Parachutist Badge (Hungarian) was omitted from his second DD Form
214.  It should be added.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by:


      a.  deleting from the awards listed on both of his DD Forms 214 the
Army Achievement Medal (2nd Award) and the Parachutist Badge;

      b.  adding the Army Achievement Medal with 2nd Oak Leaf Cluster and
the Parachutist Badge with bronze service star to both DD Forms 214.

      c.  adding the Global War on Terrorism Expeditionary Medal with
Bronze Arrowhead Device to both DD Forms 214;

      d.  adding the Joint Service Commendation Medal and the Parachutist
Badge (Hungarian) to his second DD Form 214;


      e.  deleting “11B2P – 00 YRS 00 MOS // NOTHING FOLLOWS” from item 11
of his second DD Form 214 and adding “11B10B4  – 01 YRS 01 MO// Nothing
Follows”
