THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his earlier request to have
his retired rank title changed from Sergeant Major (SGM) to Command
Sergeant Major (CSM).

2.  The applicant states he is providing a copy of Department of the Army
(DA) Circular 611-36, dated 13 April 1968, which clearly shows he was
selected for CSM by a properly-constituted selection board.

3.  The applicant provides DA Circular 611-36, dated 13 April 1968.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were
summarized in the previous consideration of the applicant's case by the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR20050011146 on 6 April 2006.

2.  The applicant was promoted to SGM on 10 March 1967.

3.  Headquarters, DA Circular 611-31, dated 15 April 1968, announced the
results of the second increment of SGMs nominated by their commanders for
entry into the CSM program.  The applicant was in that second increment.
Commanders were directed to notify the individuals concerned and to take
action to award them CSM military occupational specialty (MOS) 00Z50.  The
circular did not mention lateral appointment from SGM to CSM.

4.  The applicant apparently accepted entrance into the CSM program.  On
   19 June 1968, he was assigned to Headquarters and Headquarters Company,
2d Battalion, 26th Infantry in Vietnam where he performed duties as a CSM,
duty MOS 00Z50.

5.  The applicant was reassigned to Operations Sergeant duties on 28
February 1969.

6.  On 30June 1974, the applicant was released from active duty in the rank
of SGM and placed on the retired list effective 1 July 1974 in the rank of
SGM.

7.  In discussing the beginnings of the CSM program with the U. S. Army
Sergeants Major Academy historian in a previous case, the Board learned
that there had been some question as to whether the new CSMs would even
wear a different rank insignia from that they had worn as SGMs.  The first
evidence the historian found that a new CSM insignia was approved was an 8
April 1968 Army Times article that mentioned that the Sergeant Major of the
Army was the first SGM to wear the new CSM insignia of rank.

8.  Army Regulation 635-200 (Enlisted Personnel, Personnel Separations),
chapter 12 states that noncommissioned officers holding the grade of SGM at
retirement, whose records show they served satisfactorily as a CSM, will be
placed on the retired list in the grade title CSM.  Retirement orders on
eligible Soldiers will show active duty as SGM and placement on the retired
list as CSM.

DISCUSSION AND CONCLUSIONS:

1.  The Board cannot determine if a Government error occurred in this case.
 It appears that there was some confusion at the beginning of the CSM
program as to whether or not these selectees should even wear a different
insignia than that already worn, i.e., SGM insignia.  The applicant was
assigned to a CSM position in June 1968, only two months later than the
first selectee to wear the CSM insignia, the Sergeant Major of the Army,
did so.

2.  The applicant was subsequently reassigned to SGM duties, and he was
performing SGM duties at the time of his retirement.

3.  It would be an injustice not to grant the relief requested.  Command
Sergeant Major is a prestigious rank.  The applicant was in the second
increment to be selected to CSM and he did serve satisfactorily as a CSM.
Under current standards, he would have been appointed to CSM upon his
assignment to that position and he would have been placed on the retired
list as a CSM.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
amendment of the ABCMR’s decision in Docket Number AR20050011146 dated 6
April 2006.  As a result, the Board recommends that all Department of the
Army records of the individual concerned be corrected by showing that he
was placed on the retired list as a Command Sergeant Major.
