      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his records be corrected by showing he
enlisted in the pay grade of E-3.

2.  The applicant states that when he enlisted he had a friend join with
him; however, the referral sheet was not processed at the Military Entrance
Processing Station.

3.  The applicant provides copies of his USAREC Form 51-R-E (Regular Army
and Reserve Components Referral Sheet), his DD Form 4 Series
(Enlistment/Reenlistment Document), his DD Form 1966 Series (Record of
Military Processing), his Statement for Enlistment U.S. Army Delayed
Enlistment Program, and his Statement for Enlistment U.S. Army Enlistment
Program, in support of his request.

CONSIDERATION OF EVIDENCE:

1.  On 20 July 2005, the applicant initially enlisted in the U.S. Army
Reserve for a period of 8 years.  He requested to be discharged from the
delayed entry program and enlisted in the Regular Army on 24 August 2005,
for a period of 3 years and 24 weeks, in the pay grade of E-2.

2.  The applicant entered active duty in the pay grade of E-2 because he
completed the Army Pre-Basic Training task list, in accordance with Army
Regulation 610-210, paragraph 2-18a(14).

3.  USAERC Form 512-R-E (Regular Army and Reserve Component Referral Sheet)
shows on 24 May 2005, the applicant referred a friend and influenced him to
talk with an Army Recruiter.

4.  In the processing of this case an Advisory Opinion was obtained from
the Department of the Army, Office of the Deputy Chief of Staff, G-1,
Chief, Recruiting Policy Branch, which states that the applicant did
provide a referral while in the Delayed Entry Program, and that the USAREC
Form 512-R-E was completed and signed prior to the applicant shipping to
active duty, in accordance with Army Regulation 601-210, Chapter 2.  The G-
1 recommends approval of the applicant's request to change his enlistment
grade from pay grade E-2 to pay grade E-3.  The G-1 recommends that the
applicant be advanced to grade E-3, with a date of rank and effective date
of promotion to coincide with the date he entered active duty (24 August
2005).

5.  The applicant was provided a copy of the Advisory Opinion and concurred
with the recommendation.

6.  Army Regulation 601-210 provides, in pertinent part, that the Army
Referral Program provides incentive for increased pay.  Only referrals
received and verified prior to the date of enlistment in the Regular Army
will affect the enlistment grade.   An applicant participating in the
referral program who refers one qualified non-prior service or prior
service applicant who enlists into the Delayed Entry Program, Regular Army,
Army National Guard, or Army Reserve on or before the date the applicant
enters the Regular Army, or Initial Active Duty for training for Army
Reservist, may enlist at any time at the pay grade of E-3.

DISCUSSION AND CONCLUSIONS:

1.  Evidence shows the applicant participated in the Army Referral Program,
by referring a friend to an Army Recruiter.  The applicant's friend
enlisted in the Army on 9 August 2005, prior to his enlisting in the
Regular Army.

2.  The applicant enlisted in the Regular Army in the pay grade of E-2, as
a result of his completion of the Army Pre-Basic Training task list.  His
referral of a friend, who also enlisted in the Army, authorized his
advancement to pay grade E-3.

3.  The applicant's records should be corrected to show his advancement to
pay grade E-3, with a date of rank and effective date of 24 August 2005.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing he enlisted in the Regular Army in the pay grade of E-3, with a
date of rank and effective date of 24 August 2005, with entitlement to all
back pay and allowances.
