      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his records be corrected to show he was
awarded the Meritorious Service Medal and receipt of Department of Veterans
Affairs (VA) disability benefits.

2.  The applicant states he received notification of these awards after his
DD Form 214 (Certificate of Release or Discharge from Active Duty) was
prepared.

3.  The applicant provides copies of his DD Form 214, a DA Form 638
(Recommendation for Award), an award certificate for the Meritorious
Service Medal, and his VA Rating Decision.

CONSIDERATION OF EVIDENCE:

1.  The record shows the applicant entered active duty on 12 October 1982
and served on continuous active duty until he retired on 31 October 2005
with 23 years and 19 days of creditable service.

2.  Madigan Army Medical Center Permanent Orders Number 203-008, dated
31 July 2004, awarded the applicant the Meritorious Service Medal for the
period 14 February 2000 to 8 January 2004.

3.  Madigan Army Medical Center Permanent Orders Number 199-002, dated
18 July 2005, awarded the applicant the Meritorious Service Medal for the
period 1 November 1995 to 31 October 2005.

4.  The 19 November 2005 VA decision granted the applicant 10 percent
evaluations for each of five medical conditions, effective the date after
his retirement.

5.  The applicant’s DD Form 214 lists his awards as the Meritorious Service
Medal, the Army Commendation Medal (4th award), the Army Achievement Medal
(3rd Award), the Meritorious Unit Commendation (2nd award), the Army of
Occupation Medal, the National Defense Service Medal (2nd award), the
Global War on Terrorism Service Medal (2nd award), the Global War on
Terrorism Expeditionary Medal, the Southwest Asia Service Medal, the
Humanitarian Service Medal, the Noncommissioned Officers Professional
Development Ribbon with Numeral 3, the Army Service Ribbon, the Good
Conduct Medal (7th award),
the Kuwait Liberation Medal, the Overseas Service Ribbon (2nd award), the
Expert Field Medical Badge, the Parachutist Badge, and the Driver Merit
Badge (properly known as the Drivers and Mechanics Badge).

6.  Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that must be prepared for Soldiers on retirement, discharge,
release from active duty service, or control of the Active Army.  It is a
brief, clear-cut record of active duty service at the time of release from
active duty, retirement, or discharge.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s award of a second Meritorious Service Medal is not
reflected on his DD Form 214.  It is appropriate to correct the DD Form 214
to reflect this award.

2.  A DD Form 214 is prepared to reflect a Soldier’s military service.  The
fact that the VA has granted the applicant a disability rating and
benefits, although linked to his service, is not an Army record or decision
that is authorized to be reflected on the DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief.  As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected showing the applicant was awarded Meritorious
Service Medal with Oak Leaf Cluster.



2.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of so much of the application that pertains to
including any reference to award of a VA disability rating on the DD Form
214.
