The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his records be corrected by showing he
enlisted in the pay grade of E-3.
2. The applicant states that he should have enlisted in the pay grade of E-
3, with an effective date of 24 August 2005. He had 64 college credit
hours, and in accordance with Army Regulation 601-210, the enlistment grade
is E-3.
3. The applicant provides a copy of his college transcript and his
enlistment contract, in support of his request.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the U.S. Army Reserve on 3 August 2005 for a
period of 8 years, in the pay grade of E-2. On 24 August 2005, he
requested to be discharge from the Delayed Entry Program and enlisted in
the Regular Army for a period of 4 years, in pay grade E-2.
2. The applicant enlisted in pay grade of E-2 after presenting college
transcripts showing he had completed 45 semester credit hours.
3. In the processing of this case, an Advisory Opinion was obtained from
the U.S. Army Human Resources Command - Alexandria, Force Alignment
Division, which recommends that the applicant's request be disapproved,
noting that he was appropriately enlisted in the pay grade of E-2 based
upon the number of college credit hours he presented. The opinion
acknowledges that the applicant's additional course hours were documented
on his transcript on
22 September 2005, however, this occurred after the date of his enlistment.
4. The opinion was forwarded to the applicant for acknowledgement/rebuttal
on 26 April 2006. He did not respond.
5. Within a month of the applicant's enlistment an additional 29 credit
hours from Henry Ford Community College was posted to his transcript.
These additional credit hours were obtained during the summer of 1998 and
the fall of 1999, prior to his enlistment, giving him a total of 64 credit
hours. These additional hours of college credits were sufficient for his
enlistment in the pay grade of E-3.
6. Army Regulation 601-210 (Regular Army and Army Reserve Enlistment
Program) states, in pertinent part, that applicants who successfully
complete forty eight or more classroom semester hours at an accredited
degree granting college or university listed in the Accredited Institutions
of Postsecondary Education, may enlist at any time in pay grade E-3.
7. Army Regulation 601-210, also provides that individuals who lack
documentation required for advanced promotion at the time of enlistment may
submit supporting documents to the personnel officer within 6 months of
enlistment. It also states that credit for college course completion must
have occurred prior to date of enlistment in the Regular Army.
DISCUSSION AND CONCLUSIONS:
1. The Board notes that the applicant's additional credit hours were not
presented at the time of his enlistment, however, were obtained prior to
the date of his enlistment, and were received well within the 6 month time
frame required for receipt of promotion documents. In the interest of
justice and equity, the applicant's additional credits should be used in
determining his enlistment grade.
2. The applicant's records should be corrected to show he enlisted in the
Regular Army on 24 August 2005, in the pay grade of E-3.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing he enlisted in the Regular Army in the pay grade of E-3, with back
pay and allowances from 24 August 2005, the date of his enlistment.
