THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of his military record to show a pay grade higher than E-1 at the time of his entry on active duty. He bases this upon having completed three years of college.
2. The applicant states he received the paperwork verifying he had completed three years of college after he had enlisted but before leaving for basic combat training. His recruiter told him his records would be updated accordingly at his next duty station. He was not, however, promoted as he should have been based upon the completion of college coursework.
3. The applicant provides no additional evidence.
CONSIDERATION OF EVIDENCE:
1. Available records show, after initially enlisting in the U.S. Army Reserve Delayed Entry Program (DEP), the applicant enlisted in the Regular Army on 5 November 2013. He entered in the rank/grade of private/E-1. Following the completion of initial training, he was awarded military occupational specialty 88M (Motor Transport Operator). He currently holds the rank/grade of private first class/E-3 and has been deployed to Monrovia, Liberia in support of Operation United Assistance.
2. On his DD Form 1966/2 (Record of Military Processing - Armed Forces of the United States), in item 22 (Education), is listed what is identified as all high schools and colleges attended. The only entry shown is attendance at an Islamic Secondary School in Ghana from 2002 to 2005. There is no mention of college.
3. The applicant's Enlisted Record Brief (ERB), in Section VII (Civilian Education) contains an entry which states he completed 3 years of college (60 or more semester hours) in 2010; however, his Official Military Personnel File (OMPF) is void of any record of college transcripts, and there is no indication in his OMPF as to when transcripts may have been provided. Additionally, the applicant provides no information on when he may have presented the transcripts reflected on the ERB to proper authorities.
4. In an advisory opinion received from the U.S. Army Human Resources Command, dated 30 September 2014, the Chief of Promotions writes, in effect, Army Regulation 601-210 (Active and Reserve Components Enlistment Program) provides for cases where an enlistee lacks the documentation required for advanced promotion at the time of enlistment. When this occurs, he/she has up to 6 months to provide this documentation to his/her personnel officer. Available records show the applicant did not meet the 6-month timeframe for producing college transcripts.
5. Army Regulation 601-210 provides policy and guidance on the enlistment of active duty and Reserve Component Soldiers.
a. Paragraph 2-7 (Education), subparagraph f, states applicants who have completed a foreign high school or have college credits from foreign colleges or universities must have their documents evaluated and accredited by a State board of education, or any degree granting college or university listed in the Accredited Institutions of Post-Secondary Education (AIPE) or National Association of Credential Evaluation Services (NACES).
b. Paragraph 2-18 (Enlistment Pay Grades for Personnel without Prior Service) states Soldiers enlisting in the DEP can enter at a pay grade higher than E-1 when they have college credit. Successful completion of 24 or more semester hours allows the Soldier to enlist in the grade of E-2. Successful completion of 48 or more semester hours allows the Soldier to enlist in the pay grade of E-3. Completion of a degree-producing 4 year college program allows the Soldier to enlist in the pay grade of E-4.
DISCUSSION AND CONCLUSIONS:
1. The applicant requests his records be corrected to show an entry pay grade above E-1. He bases this request on a contention he met the requirements of Army Regulation 601-210 by having completed more than 48 semester hours of college prior to his entry on active duty.
2. Army Regulation 601-210 allows Soldiers to provide transcripts within 6 months of entry on active duty in support of attaining a grade higher than E-1. It also requires foreign transcripts to be evaluated and accredited by an institution listed in the AIPE or NACES. Soldiers who have more than 48 semester hours can enter in the grade of E-3.
3. While the applicant's ERB contains an entry showing the completion of 60 or more semester hours of college, there is no evidence he provided transcripts that had been accredited by an AIPE or NACES institution within the required 6 month timeframe. Based upon the foregoing, there is insufficient evidence to support granting the requested relief.
