RECORD OF PROCEEDINGS
IN THE CASE OF:
BOARD DATE: 8 August 2006
DOCKET NUMBER: AR20060003039
I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.
| |Mr. Carl W. S. Chun | |Director |
| |Mrs. Nancy L. Amos | |Analyst |
The following members, a quorum, were present:
| |Mr. James E. Anderholm | |Chairperson |
| |Mr. Dale E. DeBruler | |Member |
| |Mr. James R. Hastie | |Member |
The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in an inquiry to her Senator, in effect, that
she be determined to be eligible for the retired pay of her deceased
spouse, a former service member (FSM).
2. The applicant states, in the inquiry to her Senator, that the FSM
passed away in March 2004. He had until May 2004 to have his retirement
papers completed. Since the Army did not get his retirement packet, she is
being told that she is not entitled to his retirement. She knows she
cannot receive the Survivor Benefit Plan (SBP) because the FSM did not
elect to participate in it at an earlier date. All she is after is his
retirement.
3. The applicant provides the FSM’s Chronological Statement of Retirement
Points; their marriage certificate; his death certificate; his application
for retired pay; and a 16 August 2005 letter from the Defense Finance and
Accounting Service (DFAS) to a Member of Congress.
CONSIDERATION OF EVIDENCE:
1. The FSM was born on 18 February 1945. He enlisted in the U. S. Army
Reserve on 17 August 1964. He married the applicant on 20 August 1982.
2. The FSM’s notification of eligibility for retired pay at age 60 (his 20-
year letter) is not available. The 16 August 2005 letter from DFAS to the
Member of Congress indicated the FSM did not elect to participate in the
Reserve Component SBP, which is confirmed by the applicant’s statement to
her Senator.
3. Apparently around February 2004, the applicant initiated his
application for retired pay.
4. The FSM died on 10 March 2004 at age 59.
5. In a 1 February 2006 letter from the applicant’s Member of Congress to
the Board, the Member of Congress stated the applicant knows she is not
eligible for survivor benefits, but is requesting consideration for
retirement benefits.
6. Sections 12731 through 12738 of Title 10, U.S. Code, authorize retired
pay for Reserve component military service. Under this law, a Reserve
Soldier must complete a minimum of 20 qualifying years of service to be
eligible for retired pay at age 60.
DISCUSSION AND CONCLUSIONS:
1. The FSM died at age 59, prior to becoming eligible to draw retired pay.
Regrettably, since the FSM did not live to become eligible to draw retired
pay, the applicant is not entitled to any portion of that pay.
2. If the applicant’s concern is with benefits associated with a military
identification card, she should visit the nearest military personnel office
to determine if she remains eligible for a military identification card.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
__jea___ __ded___ __jrh___ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.

The applicant, the former spouse of a deceased former service member (FSM), requests reconsideration of her previous request for correction of the FSM's records to show he changed his Survivor Benefit Plan (SBP) annuity election from "spouse" to "former spouse" coverage within 1 year of his divorce. In their response, DFAS made the following points: * the FSM originally elected SBP coverage for his spouse * upon their Judgment of Divorce, dated 6 February 1997, the applicant lost her...
ARMY | BCMR | CY2009 | 20090006310
The FSM's military service records show that he enlisted in the Army National Guard (ARNG) on 5 August 1977. At the time both the FSM and the applicant were 59 years of age. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing the applicant applied for the SBP annuity in a timely manner and to pay her the annuity retroactive to the day the FSM would have turned age 60.
ARMY | BCMR | CY2004 | 2004099916C070208
The record shows that neither the FSM nor the applicant took any action to request a change to the FSM’s SBP election to former spouse coverage within a year of the divorce decree being issued, as is required by law. On 10 November 2003, in letter response to a Congressional Inquiry, the DFAS indicated their records indicated the applicant did not request to change his SBP election to former spouse and that the applicant did not make a deemed election for former spouse coverage. The...

The applicant requests, in effect, correction of the records of her deceased husband, a retired former service member (FSM), to show: * he made a timely application for retired pay at age 60 * he made an election for spouse coverage, full base amount under the Survivor Benefit Plan (SBP) at age 60 in a timely manner * she filed a claim for a survivor benefit annuity in a timely manner following the FSM's death 2. Evidence further indicates the FSM was married to the applicant when he failed...

Counsel also states that the applicant and FSM had 3 children together who are now adults; that the applicant and FSM never divorced, although they were separated at the time of his death because of his philandering; and neither attempted to terminate their marriage of 26 years. DD Form 149 (Application for Correction of Military Record Under the Provisions of Title 10, U.S. Code, Section 1552) dated 14 February 2008 shows that the applicants surname is not that of the FSM. However, the...
ARMY | BCMR | CY2014 | 20140000840
The applicant, the widow of a deceased former service member (FSM), requests, in effect, correction of the FSM's record to show she filed a claim for a survivor benefit annuity on the day following the FSM's death and payment of unpaid benefits from that date. She only got her identification card in 2003 when she was advised of her benefits by the Army National Guard (ARNG) at which time the FSM's military records still showed him as alive and married to his former spouse. The applicant...
ARMY | BCMR | CY2011 | 20110001327
The applicant requests, in effect, the records of her deceased husband, a former service member (FSM), be corrected to show she is entitled to a Survivor Benefit Plan (SBP) annuity. Public Law 94-397, the RCSBP, enacted 30 September 1978, provided a way for those who had qualified for Reserve retirement but were not yet age 60 to provide an annuity for their survivors should they die before reaching age 60. Under the law in effect at the time, a member was required to make the RCSBP...
ARMY | BCMR | CY2005 | 20050005632C070206
On 22 October 1999, the FSM elected to terminate his participation in the SBP. The applicant's daughter is listed as the annuitant on DFAS's 17 February 2005 letter to the applicant. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. showing the FSM did not request termination of his SBP in October 1999 but continued to remain enrolled in the SBP for child-only coverage; b. collecting any SBP costs due; and c. paying to...
ARMY | BCMR | CY2010 | 20100021535
The applicant provides: * a memorandum to the FSM from the Military Department of Arkansas, Office of The Adjutant General, subject: Notification of Eligibility for Retired Pay at Age 60, dated 21 March 1988 * the FSM's DD Form 214 (Certificate of Release or Discharge from Active Duty) * a self-authored letter to AR-PERSCOM, dated 27 September 2002, with the following attachments: * the FSM's State of Arkansas Certificate of Death which shows the informant's name as "B---y M--------n" [the...

The applicant provides the death certificate; a notification from the Defense Finance and Accounting Service (DFAS); a court reporter brief; written transcripts of the trial with a copy of tapes of the trial; the divorce decree; paperwork filed for a portion of retired pay and SBP annuity; Office of Personnel Management's 25 August 1986 acknowledgement for the paperwork sent for the court-ordered former spouse annuity; the request for deemed election; a 3 February 1997 acknowledgement of...
