      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of the Board’s denial of his
request to award him constructive service credit for his Master’s Degree in
Pathology.

2.  The applicant states that he now has evidence to show that his Master’s
Degree is reflective of the name of the department conducting the course of
study, and does not actually reflect the coursework completed.  He contends
that his Master’s Degree is actually in basic science and immunology, both
of which qualify for constructive service credit in accordance with the
applicable Army regulation.

3.  The applicant provides a letter from the Associate Dean for Graduate
Education, College of Medicine, University of Florida.  In that letter the
course requirements for the applicant’s Master’s Degree in Pathology is
outlined, and it was stated that the applicant’s degree was a basic science
degree with an emphasis in immunology.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were
summarized in the previous consideration of the applicant's case by the
Army Board for Correction of Military Records (ABCMR) in Docket Number
AR20050004554 on 25 October 2005.

2.  In its original consideration, the Board determined that the
applicant’s Master’s Degree in Pathology did not qualify for constructive
service credit.  This was based on the fact that Pathology is not a degree
which is listed in Army regulations as one which is authorized constructive
service credit, and the fact that the Office of The Surgeon General (OTSG)
provided an advisory opinion which stated that the applicant’s advanced
degree in Pathology does not tangibly add any value to his primary
specialty of internal medicine, nor reduce the expected length of training
to meet specialty board requirements.

3.  In the applicant’s official academic transcript for his Master’s
Degree, it is shown that the applicant took five Pathology
classes/seminars, and took four classes for Pathology and Immunology.  The
transcript shows that he was awarded a Master of Science in Pathology.



4.  In the letter from the Associate Dean for Graduate Education, College
of Medicine, University of Florida, the course requirements for the
applicant’s Master’s Degree in Pathology was outlined, and it was stated
that the applicant’s degree was a basic science degree with an emphasis in
immunology, and it would be appropriate for the Army to classify the
applicant’s Master’s Degree as such.  This letter is new evidence and
requires the Board to reconsider the applicant’s request.

DISCUSSION AND CONCLUSIONS:

1.  As noted by the Board it its original review of this case, the
applicant has a Master’s Degree in Pathology, which is not an advanced
degree which is authorized constructive service credit.  The OTSG has
stated that the applicant’s advanced degree in Pathology does not tangibly
add any value to his primary specialty of internal medicine, nor reduce the
expected length of training to meet specialty board requirements.

3.  The letter from the Associate Dean for Graduate Education, College of
Medicine, University of Florida, has been carefully considered.  While the
Dean has stated that it would be appropriate to classify the applicant’s
Master’s Degree as a basic science degree with an emphasis in immunology,
he does not state that the applicant was erroneously given a degree in
Pathology.  Since constructive service credit is granted for completion of
degrees, and since Pathology is not a degree which is authorized
constructive service credit, the applicant is not entitled to constructive
service credit for his Master’s Degree.

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable
error or injustice.  Therefore, the Board determined that the overall
merits of this case are insufficient as a basis to amend the decision of
the ABCMR set forth in Docket Number AR20050004554 on 25 October 2005.
