The Board considered the following evidence:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his records be corrected to reflect award
of the Purple Heart and the Combat Infantryman Badge.
2. The applicant makes no statement.
3. The applicant provides a copy of orders confirming his entitlement to
the Purple Heart.
CONSIDERATION OF EVIDENCE:
1. Records available to the Board indicate the applicant was commissioned
as an infantry second lieutenant in November 1966, following completion of
Officer Candidate School and entered active duty.
2. In August 1967 he was assigned to Vietnam as an infantry platoon leader
with the 1st Battalion, 18th Infantry. On 29 October 1967 he was wounded
as a result of hostile action and subsequently medically evacuated from
Vietnam. Orders confirming his award of the Purple Heart were published by
the 93rd Evacuation Hospital. The applicant was also awarded a Silver Star
as a result of his heroic action on the day he was wounded. His separation
document reflects his award of the Silver Star but not his award of the
Purple Heart.
3. Following completion of medical treatment the applicant was restored to
duty at Fort Campbell, Kentucky. In February 1970 he returned to duty in
Vietnam first as a member of the 3rd Brigade, 9th Infantry and subsequently
as a member of the 1st Battalion, 5th Infantry. He remained in Vietnam
until February 1971.
4. On 2 September 1973 the applicant was released from active duty. There
is no indication he was ever awarded the Combat Infantryman Badge.
5. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part,
that the Combat Infantryman Badge is awarded to infantry officers and to
enlisted and warrant officer persons who have an infantry military
occupational specialty (MOS). They must have served in active ground
combat while assigned or attached to an infantry unit of brigade,
regimental or smaller size.
6. A review of Department of the Army Pamphlet 672-3 (Unit Citation and
Campaign Participation Credit Register) notes the applicant would have been
credited with participating in four designated campaigns (Vietnam
Counteroffensive, Vietnam Winter-Spring 1970, Sanctuary Counteroffensive,
and Vietnam Counteroffensive Phase VII) during his two tours of duty in
Vietnam. Four bronze service stars on the Vietnam Service Medal, which is
recorded on his separation document, should reflect his campaign
participation. The applicant is also entitled to a Valorous Unit Award,
the Republic of Vietnam Gallantry Cross Unit Citation with Palm, and the
Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation as
a result of his service in Vietnam. The unit awards were also omitted from
his separation document.
DISCUSSION AND CONCLUSIONS:
1. The evidence confirms the applicant was awarded the Purple Heart. His
records should be corrected to reflect that decoration.
2. The evidence also confirms the applicant was an infantry officer,
assigned to an infantry unit, and his award of the Purple Heart and Silver
Star are evidence of his participation in ground combat. As such, he meets
the requirements for award of the Combat Infantryman Badge and his records
should be corrected accordingly.
3. The evidence also shows the applicant is entitled to four bronze
service stars on his Vietnam Service Medal, a Valorous Unit Award, the
Republic of Vietnam Gallantry Cross Unit Citation with Palm and the
Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation as
a result of his service in Vietnam. That information should also be added
to his separation document.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by:
a. showing he was awarded the Purple Heart;
b. awarding him the Combat Infantryman Badge; and
c. by showing that he is entitled to four bronze service stars on his
Vietnam Service Medal, a Valorous Unit Award, the Republic of Vietnam
Gallantry Cross Unit Citation with Palm, and the Republic of Vietnam Civil
Actions Honor Medal First Class Unit Citation.

In December 1967, while a member of C Company, 1 st Battalion (Airborne), 506 th Infantry, the applicant was transferred to Vietnam as part of a unit move. His separation document does not reflect entitlement to the Purple Heart but does reflect entitlement to the National Defense Service Medal, Vietnam Service Medal and Vietnam Campaign Medal. As such the Board concludes that the applicant is entitled to an award of the Parachutist Badge and his record should be corrected accordingly.
