         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to reflect award of the Purple Heart. He states he sustained an injury to his eye while in Vietnam and was hospitalized for treatment. He notes that the Purple Heart is not "listed as an earned decoration."

3. Records available to the Board indicate the applicant entered active duty on
10 May 1967 and was discharged for the purpose of immediate reenlistment on 20 August 1968. In October 1968 he was assigned to Vietnam.

4. Orders issued by the 93rd Evacuation Hospital on 2 April 1969 confirm the applicant was awarded the Purple Heart for wounds sustained on 1 April 1969. In addition to the Purple Heart, the applicant was also awarded two awards of the Bronze Star Medal, an Army Commendation Medal, the Combat Infantryman Badge and an Air Medal. The applicant returned to the United States in April 1970.

5. He was discharged for the purpose of immediate reenlistment on 22 July 1971. The DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) does not reflect entitlement to the Purple Heart, Army Commendation Medal or his second award of the Bronze Star Medal. The form also incorrectly reflects his "date of entry" as 21 August 1969 when in fact the date should have been 21 August 1968. Item 22a (net service this period) correctly reflects 2 years, 11 months, and 2 days, which would indicate service between 1968 and 1971, not 1969 and 1971, as currently reflected on the document.

6. A review of Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) notes the applicant was a member of F Company, 75th Infantry when it was awarded a Valorous Unit Award. He is also entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal Unit Citation and a silver service star on his Vietnam Service Medal, representing participation in five designated campaign periods (Vietnam Counteroffensive-Phase V and Phase VI, Tet 69 Counteroffensive, Vietnam Summer-Fall 1969 and Vietnam Winter-Spring 1970) during his tour of duty in Vietnam.

CONCLUSIONS:

1. The evidence confirms the applicant was awarded a Purple Heart for wounds sustained as a result of hostile action while in Vietnam. His records should be corrected accordingly.

2. The evidence also confirms the applicant was awarded an Army Commendation Medal and a second award of the Bronze Star Medal while in Vietnam. Those awards should also be reflected on his 22 July 1971 DD Form 214.

3. The applicant is also entitled to a Valorous Unit Award, the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal Unit Citation and a silver service star on his Vietnam Service Medal.

4. The Board also notes that his date of entry on his 22 July 1971 DD Form 214 is incorrect and should be corrected to reflect 21 August 1968 vice 21 August 1969.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by correcting the applicant's 22 July 1971 DD Form 214 to show his date of entry was 21 August 1968 vice 21 August 1969;

b. by showing on the 22 July 1971 DD Form 214 that the applicant was awarded a Purple Heart, an Army Commendation Medal and two awards of the Bronze Star Medal; and

c. by showing that he is entitled to a Valorous Unit Award, the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal Unit Citation and a silver service star on his Vietnam Service Medal.
