      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his “date of enlistment” item 4, on his NGB Form
22 (Report of Separation and Record of Service) be corrected to read
31 August 1980 instead of 31 August 1989.

2.  The applicant states his “date of rank” item 6, and his “record of
service” item 10, conflict with his “date of enlistment” item 4.

3.  The applicant provides a copy of his NGB Form 22 and his
Noncommissioned Officer Evaluation Report (NCOER).

CONSIDERATION OF EVIDENCE:

1.  The applicant’s record shows he enlisted in the Army National Guard on
      13 January 1980 and through a series of reenlistments continued his
service in the National Guard.

2.  The applicant’s NGB Form 22 dated 9 November 2004, lists his date of
enlistment in item 4 as 31 August 1989.  His date of rank in item 6 is
listed as     6 April 1987.  The applicant’s record of service shows his
net service this period as 15 years, 2 months and 9 days.

3.  The applicant’s draft NCOER from December 2003 through November 2004
shows his date of rank to E-5 as 6 April 1987.

4.  The applicant’s DD Form 4/1 (Enlistment/Reenlistment Document) shows
his date of enlistment as 31 August 1989. This document shows that the
applicant enlisted on the above date for 1 year.

5.  DA Form 4836 (Oath of Extension of Enlistment or Reenlistment) verifies
that through a series of extensions the applicant’s last
enlistment/reenlistment date of 31 August 1989 was extended to a new
expiration term of service of                  30 August 2005.

6.  National Guard Regulation 600-200 (Enlisted Personnel Management)
establishes standardized policy for preparing and distributing the NGB Form
22. Table 8-2 requires the preparer to enter, in item 4, the date of
enlistment from the latest DD Form 4.



DISCUSSION AND CONCLUSIONS:

1.  Record of evidence shows the applicant’s latest DD Form 4/1 is dated
      31 August 1989.  Therefore, based on the regulatory guidelines, the
date of enlistment as listed on his NGB Form 22 is correct.  The fact that
this date conflicts with the applicant’s record of service is irrelevant.
The date of the last enlistment is not required to equal the applicant’s
“total” creditable service as listed in item 10.

2.  In order to justify correction of a military record the applicant must
show, or it must otherwise satisfactorily appear, that the record is in
error or unjust.  The applicant has failed to submit evidence that would
satisfy that requirement.

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable
error or injustice.  Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.
