The Board considered the following evidence:

Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that award of the Global War on
Terrorism Expeditionary Medal (GWOTEM) and the Global War on Terrorism
Service Medal (GWOTSM) be added to his DD Form 214 (Certificate of Release
or Discharge from Active Duty). He also requests any additional awards to
which he is entitled be added to his DD Form 214.
2. The applicant states, in effect, that the GWOTEM, the GWOTSM and all
other awards to which he is entitled should be added to his DD Form 214.
3. The applicant provides a copy of his active duty orders and amendment
order, his separation orders, and his DD Form 214.
CONSIDERATION OF EVIDENCE:
1. The applicant served in support of Operation Iraqi Freedom.
2. The applicant initially enlisted in the Army National Guard on 20
October 1982. He was ordered to active duty for training (ADT) on 12
January 1983 and was released from ADT on 15 April 1983. He was
transferred back to his National Guard unit.
3. Headquarters, 2nd Battalion, 117th Field Artillery, Alabama Army
National Guard Permanent Order Number 2-30 dated 30 April 1988 awarded the
applicant the Army Achievement Medal (2nd Award) for service from 16 April
1988 through 30 April 1988. His service records do not contain orders for
the first award of the Army Achievement Medal.
4. Headquarters, 2nd Battalion, 117th Field Artillery, Auburn, Alabama
Permanent Order Number 2-3 dated 25 July 1992 awarded the applicant the
Army Achievement Medal for meritorious achievement from 15 June 1991
through 25 July 1992.
5. The applicant was discharged from the Army National Guard and as a
Reserve of the Army on 19 October 1995.
6. After a break in service, the applicant enlisted in the Army National
Guard again on 19 August 1998.
7. Headquarters, 31st Support Battalion, Enterprise, Alabama Permanent
Order Number 58-2000 dated 3 November 2000 awarded the applicant the Army
Achievement Medal for meritorious service from 1 October 1999 through
19 August 2000.
8. Headquarters, 31st Support Battalion, Enterprise, Alabama Permanent
Order Number 149-01 dated 11 June 2001 awarded the applicant the Army
Achievement Medal for meritorious service from 2 June 2001 through 16 June
2001.
9. The applicant was ordered to active duty on 10 February 2003 in support
of Operation Enduring Freedom.
10. The applicant was awarded the Driver Badge with Wheel-W Bar by
419th Transportation Battalion Permanent Orders Number 033-095 dated
2 February 2004.
11. He served in Iraq from 20 March 2003 through 7 March 2004.
12. The applicant was released from active duty on 1 April 2004 at the
completion of his required active service. His DD Form 214 for the period
ending 1 April 2004 shows he was awarded the Army Achievement Medal (Third
Award), the Army Reserve Components Achievement Medal (Second Award), the
National Defense Service Medal (Second Award), the Army Lapel Button, the
Humanitarian Service Medal, the Armed Forces Reserve Medal with “M” Device,
the Noncommissioned Officer’s Professional Development Ribbon with
Numeral 2, the Army Service Ribbon, and the Marksman Marksmanship
Qualification Badge with Rifle Bar.

disseminated implementing instructions for award of the GWOTEM for Soldiers
who deploy abroad for service in the Global War on Terrorism Operations on
or after 11 September 2001 to a date to be determined. To be eligible for
this award a Soldier must be mobilized with or assigned or attached to a
unit participating in designated operations for 30 consecutive days or for
60 nonconsecutive days in the areas of eligibility designated, or must meet
one of the following criteria: a) be engaged in actual ground combat
against the enemy and under circumstances involving grave danger of death
or serious bodily injury from enemy action, regardless, of the time in the
area of eligibility; b) while participating in the designated operation,
regardless of time, is killed or wounded/injured requiring medical
evacuation from the area of eligibility, or
c) participate as a regularly assigned air crew member flying sorties for
30 consecutive days or 60 nonconsecutive days into, out of, within, or over
the area of eligibility in direct support of Operations Enduring Freedom
and/or Iraqi Freedom. The message also states that under no condition will
any Soldier in the United States receive this award.

limited initial award of the GWOTEM to Soldiers who deployed abroad in
Operations Enduring Freedom and Iraqi Freedom in the following areas of
eligibility (AOE): Afghanistan, Bahrain, Bulgaria (Bourgas), Crete,
Cyprus, Diego Garcia, Djibouti, Egypt, Eritrea, Ethiopia, Iran, Iraq,
Israel, Jordan, Kazakhstan, Kenya, Kuwait, Kyrgyzstan, Lebanon, Oman,
Pakistan, Philippines, Qatar, Romania (Constanta), Saudi Arabia, Somalia,
Syria, Tajikistan, Turkey (east of 35 east degrees east latitude),
Turkmenistan, United Arab Emirates, Uzbekistan, Yemen, that portion of the
Arabian Sea north of 10 degrees north latitude and west of 68 degrees
longitude, Bab El Mandeb, Gulf of Aden, Gulf of Aqaba, Gulf of Oman, Gulf
of Suez, that portion of the Mediterranean Sea east of 28 degrees east
longitude, Persian Gulf, Red Sea, Strait of Hormuz, and Suez Canal.

disseminated implementing instructions for award of the GWOTSM. This award
is designated for Soldiers who have participated in or served in support of
Global War on Terrorism Operations outside of the designated area of
eligibility determined for award of the GWOTEM on or after 11 September
2001 to a date to be determined. All Soldiers on active duty, including
Reserve Component Soldiers mobilized or National Guard Soldiers activated,
on or after 11 September 2001 to a date to be determined having served 30
consecutive days or 60 nonconsecutive days are authorized this award.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows the applicant served in Iraq in support of
Operation Iraqi Freedom from 20 March 2003 through 7 March 2004. Therefore,
he served a period of qualifying service for award of the GWOTEM and the
GWOTSM.
2. The evidence of record shows the applicant was awarded a second award
of the Army Achievement Medal in April 1988; a third award of the Army
Achievement Medal in July 1992; a fourth award of the Army Achievement
Medal in November 2000; and a fifth award of the Army Achievement Medal in
June 2001. However, his DD Form 214 for the period ending 1 April 2004
reflects only three awards of the Army Achievement Medal. Therefore, it
would be appropriate to amend his DD Form 214 for the period ending 1 April
2004 to reflect two additional awards of the Army Achievement Medal.
3. Permanent orders show the applicant was awarded the Driver Badge with
Driver-W Bar; therefore, this badge should be added to his DD Form 214 for
the period ending 1 April 2004.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by:
a. amending his DD Form 214 for the period ending 1 April 2004 to
show he was awarded the GWOTEM and the GWOTSM;
b. deleting the Army Achievement Medal (Third Award) from his DD Form
214 for the period ending 1 April 2004; and
c. adding the Army Achievement Medal (Fifth Award) to his DD Form 214
for the period ending 1 April 2004.

The applicants Enlisted Record Brief, dated 5 September 2002, shows that he was awarded only the Army Service Ribbon and no other awards or badges. The evidence of record and the evidence provided by the applicant show he deployed to Kuwait in support of Operation Enduring Freedom.
