The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his enlistment contract be corrected to
show his correct name.
2. The applicant states that his name on his enlistment contract should be
changed to read Cruz-Olivencia, Orlando, and not Cruz Orlando Olivencia.
3. The applicant provides a copy of his DD Form 4/1 and DD Form 4/2, a
Memorandum for Record (MFR) from the U.S. Army Recruiting Command, 43rd
Adjutant General Battalion, Fort Leonard Wood, Missouri, a copy of his
training of choice reservation notification, a Statement of Understanding
in support of his request, and copy of his DD Form 214 (Certificate of
Release or Discharge from Active Duty).
CONSIDERATION OF EVIDENCE:
1. The applicant’s DD Form 4/1, shows that he enlisted in the Regular Army
on
3 May 2005, as Cruz Orlando Olivencia.
2. The applicant’s DD Form 214 indicates he was released from initial
active duty training (IADT) on 22 January 2004, as Cruz-Olivencia, Orlando.
3. On 18 May 2005, a Memorandum for Record (MFR) from the U.S. Army
Recruiting Command (USAREC), 43d Adjutant General Battalion, Fort Leonard
Wood, Missouri, confirmed that the DD Form 4/1 is incorrect and his name
should read Cruz-Olivencia, Orlando.
4. The applicant’s training of choice reservation notification shows his
name as Cruz-Olivencia, Orlando.
DISCUSSION AND CONCLUSIONS:
1. An error was made during the preparation of the applicant’s enlistment
contract, which resulted in his name being listed incorrectly on his DD
Form 4/1.
2. The applicant's enlistment contract erroneously shows his name as Cruz
Orlando Olivencia. The MFR from USAREC dated 18 May 2005, and his training
of choice reservation notification confirmed that his DD Form 4/1 is
incorrect and should be corrected to reflect his correct name as Cruz-
Olivencia, Orlando.
