      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his records be corrected to show award of
the Good Conduct Medal (5th award) and a second Meritorious Service Medal.

2.  The applicant states that these awards were received after his
discharge paperwork had been completed and as such did not get entered onto
his final DD Form 214 (Certificate of Release or Discharge from Active
Duty).

3.  The applicant provides copies of a DA Form 638 (Recommendation for
Award) for a Washington Army National Guard (WAARNG) Legion of Merit, with
permanent orders Number 329-02; a 29 October 2004 memorandum and orders for
the Army Good Conduct Medal (5th award), and his retirement DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the United States Army Reserve (USAR) on
14 November 1979 under the Delayed Entry Program (DEP).  He entered active
on 19 June 1980 and served until 26 September 1984 when he transferred to
the Maryland Army Reserve.  He was honorably discharged from the USAR on
14 November 1986.

2.  The applicant reentered military service on 17 November 1988.

3.  The records available to the Board do not contain any information
related to the applicant's period of service from his reenlistment on 17
November 1988 through his retirement on 30 November 2004.

4.  While the specifics of his service are not available, it appears that
most of his service was as a member of the WAARNG in an Active
Guard/Reserve (AGR) status.

5.  Headquarters Detachment, 96th Troop Command, Tacoma, Washington
Memorandum, dated 29 October 2004, indicates the applicant was awarded the
Good Conduct Medal (5th award).

6.  On 24 November 2004 the applicant was awarded the Meritorious Service
Medal for his service from 19 June 1989 through 30 November 2004.  The
available certificate indicates this was in accordance with Joint Forces,
Headquarters Washington (Army Command), Camp Murray, Tacoma, Washington
Permanent Orders Number 329-01.

7.  A DA Form 638 recommended the applicant for award of the "WALOM"
(Washington Legion of Merit) for his service from June 1980 through
November 2004.  The initial recommendation was submitted on 1 November 2004
and final approval and authorization of the award is dated 24 November
2004.  The final approval blocks indicate that the Washington Army National
Guard State Adjutant approved the award and that Joint Forces, Headquarters
Washington (Army Command), Camp Murray, Tacoma, Washington Permanent Orders
Number 329-02 awarded the applicant the Washington Legion of Merit.

8.  The DD Form 214, dated 30 November 2004 indicates at:

      a.  Block 2 (Department, Component and Branch), service in the
Army/ARNG;

      b.  Block 12 (Record of Service), that he entered active duty on
17 November 1988, served 16 years and 14 days.  He had 4 years, 1 month,
and 7 days of prior active duty and 2 years, 8 months, and 12 days of prior
inactive duty; and

      c.  Block 13 (Decoration, Medals, Badges, Citations and Campaign
Ribbons Awarded or Authorized), lists his awards as the Meritorious Service
Medal, the Army Commendation Medal (6th Award), the Army Achievement Medal
(3rd award), the Good Conduct Medal (4th award), the National Defense
Service Medal (2nd award), the Global War on Terrorism Service Medal, the
Armed Forces Reserve Medal, the Noncommissioned Officers Professional
Development Ribbon with Numeral 3, the Army Service Ribbon, the Army
Reserve Components Overseas Training Ribbon (2nd award), and the
Parachutist Badge.

9.  Army Regulation 635-5 (Separation Documents) states, in pertinent part,
that only the awards listed in Army Regulation 600-8-22 (Military Awards)
will be recorded in block 13 of a DD From 214.

DISCUSSION AND CONCLUSIONS:

1.  It appears, based on the documentation submitted, that the applicant
may be confusing the recommendation of the "WALOM" for an award of a second
Meritorious Service Medal.  The WALOM medal is not a Federal award but
rather a State of Washington issued medal and it is not appropriate to list
it on the DD Form 214.


2.  The applicant has provided no evidence and the available records do not
contain any indication of award of a Meritorious Service Medal other than
the one issued for his service from 19 June 1989 through 30 November 2004.


3.  The available evidence indicates that the applicant was awarded the
Good Conduct Medal (5th award); however, it should be shown on the DD Form
214 issued at the time of his retirement.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief.  As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected by showing that the applicant was awarded the Good
Conduct Medal (5th award).

2.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of so much of the application that pertains to
award of a second Meritorious Service Medal or inclusion of the Washington
Legion of Merit on the DD Form 214.
