The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that Item 11 (Primary Specialty) and
Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons) of
his 31 October 2003 separation document (DD Form 214) be corrected.
2. The applicant states, in effect, that Item 11 of his DD Form 214 should
contain an entry that shows he served in the specialty of 91B (Maintenance
Management) for 2 years and 8 months and that he served in the specialty
12A (Armor-General) for 1 year and 10 months. He also claims that based on
his service in Iraq, he is entitled to the Global War on Terrorism
Expeditionary Medal (GWOTEM) and Global War on Terrorism Service Medal
(GWOTSM), which should be added to Item 13 of his DD Form 214.
3. The applicant provides the following documents in support of his
application: Service School Academic Evaluation Reports (DA Forms 1059),
dated
29 September 1999 and 6 April 2001, respectively; and Iraq Assignment
Orders.
CONSIDERATION OF EVIDENCE:
1. On 1 May 1999, the applicant was commissioned a second lieutenant in
the United States Army Reserve (USAR) and entered active duty as a
commissioned officer.
2. On 24 September 1999, the applicant completed the Officer Basic Course
(OBC) in specialty 12A (Armor), and was assigned to Fort Hood, Texas as a
tank platoon leader.
3. On 6 April 2001, the applicant completed the Ordnance Branch
Qualification Course in specialty 91B (Maintenance Management), and was
assigned back to Fort Hood as a maintenance control officer.
4. The record confirms the applicant was deployed to Iraq in support of
Operation Enduring Freedom on 2 April 2003, and that during this
deployment, he served as a battalion logistics officer for a forward
deployed battalion for
3 months and 21 days until 22 July 2003.
5. On 31 October 2003, the applicant was honorably released from active
duty (REFRAD) at the completion of his required active service after
completing a total of 4 years and 6 months of active military service.
6. The DD Form 214 issued to the applicant shows he held the rank of
captain on the date of his REFRAD. Item 11 contains an entry that shows he
served in the specialty 91B for 3 years and 11 months and the specialty 12Z
(Battalion Logistics Officer) for 1 year and 5 months. Item 13 shows he
earned the following awards during his active duty tenure: Army Lapel
Button; Army Achievement Medal; National Defense Service Medal; and Army
Service Ribbon.
7. Executive Order Number 13289, dated 12 March 2003, established two new
medals for service in the Global War on Terrorism (GWOT). They are the
GWOTEM and the GWOTSM. These medals are awarded to recognize all members
of the Armed Forces of the United States serving in, or in support of GWOT
operations on or after 11 September 2001.
8. The GWOTEM guidance specifies that to be eligible for this award, a
Soldier must be assigned, attached or mobilized to a unit participating in
designated operations for 30 consecutive days or 60 non-consecutive days in
designated Areas of Expedition (AOE), or meet one of the following
criteria: (a) be engaged in actual combat against the enemy and under
circumstances involving grave danger of death or serious bodily injury from
enemy action, regardless of the time in the area; (b) is killed or
wounded/injured requiring medical evacuation from the AOE; (c) Soldiers
participating as a regularly assigned air crew member flying sorties into,
out of, within, or over an AOE in direct support of operations Enduring
Freedom and/or Iraqi Freedom, each day that one or more sorties are flown
counts as one toward the 30 consecutive or 60 non-consecutive day
requirement. Finally, under no conditions will any Soldiers in the United
States receive the GWOTEM. Only Soldiers serving in an operationally
deployed status in a designated AOE are eligible for the GWOTEM. Iraq is
considered an AOE for the GWOTEM.
9. The GWOTSM is authorized to be awarded to Soldiers who have
participated in or served in support of GWOT operations outside a
designated AOE on or after 11 September 2001. Initial award of the GWOTSM
will be limited to airport security operations from 27 September 2001
through 31 May 2002, who supported operations Noble Eagle, Enduring Freedom
and Iraqi Freedom. All Soldiers on active duty, including Reserve
Component Soldiers mobilized and National Guard Soldiers activated on or
after 11 September 2001, having served 30 consecutive days or 60 non-
consecutive days, are authorized the GWOTSM.
10. Army Regulation 635-5 (Separation Documents) prescribes the separation
documents that must be prepared for Soldiers on retirement, discharge,
release from active duty service, or control of the Active Army. It also
establishes standardized policy for preparing and distributing the DD Form
214.
11. Chapter 2 of the separation document regulation contains item-by-item
instructions for preparing the DD Form 214. It states, in pertinent part,
that the entry in Item 11 will include the titles of all specialties served
in for at least 1 year and be entered with the specialty number and the
number of years and months served in the specialty.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record confirms the applicant served in the primary
specialty of 12B for 1 year and 10 months, and in the primary specialty of
91B for 2 years and 8 months, as indicated by the applicant. Therefore, it
would be appropriate to amend Item 11 of the applicant’s DD Form 214 by
deleting the current entries and replacing them with the entries: “91B-
Maintenance Management --
2 years-8 months” and “12B-Armor General--1 year-6 months.”
2. The evidence of record also confirms the applicant served on active
duty from
1 May 1999 through 31 October 2003, and that he served in Iraq in support
of Operation Enduring Freedom, an authorized AOE, from 2 April through 22
July 2003. Therefore, he is entitled to both the GWOTSM and GWOTEM.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
amending his 31 October 2003 DD Form 214 as follows: Item 11-delete the
current entries and replace them with the entries “91B--Maintenance
Management-2 years-8 months” and 12A--Armor General-1 year-10 months; Item
13- by adding the Global War on Terrorism Expeditionary Medal and Global
War on Terrorism Service Medal; and by providing him a corrected separation
document that includes these changes.
