                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 19 OCTOBER 2005
      DOCKET NUMBER: AR20050002062

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Ms. Deborah L. Brantley | |Senior Analyst |

The following members, a quorum, were present:

| |Ms. Barbara Ellis | |Chairperson |
| |Mr. Hubert Fry | |Member |
| |Mr. Robert Rogers | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his separation document be corrected to
reflect award of the Purple Heart.

2. The applicant states he received the award after he was out of the
Army.

3. The applicant provides a copy of orders awarding him the Purple Heart,
a copy of the award certificate, and a copy of his 1969 separation
document.

CONSIDERATION OF EVIDENCE:

1. Records available to the Board indicate the applicant was inducted and
entered active duty on 10 August 1967. Following completion of training,
in January 1968 he was assigned to the 11th Armored Cavalry Regiment in
Vietnam.

2. According to documents in his file, he was wounded as a result of
hostile action on 18 September 1968 and evacuated from Vietnam to the
United States via Japan. Orders confirming his award of the Purple Heart
were issued on
20 September 1968 by the 24th Evacuation Hospital.

3. The applicant completed his service commitment at Fort Hood, Texas and
on 8 August 1969 was released from active duty with an honorable
characterization of service. His separation document does not reflect
entitlement to the Purple Heart.

4. A review of Department of the Army Pamphlet 672-3 (Unit Citation and
Campaign Participation Credit Register) notes the applicant’s unit in
Vietnam was awarded the Republic of Vietnam Gallantry Cross Unit Citation
with Palm and a Valorous Unit Award during his tenure with the
organization. The unit awards were also omitted from his separation
document.

DISCUSSION AND CONCLUSIONS:

1. The evidence confirms the applicant was awarded the Purple Heart for
wounds sustained as a result of hostile action in Vietnam. His records
should be corrected accordingly.

2. The evidence also shows the applicant is entitled to the Republic of
Vietnam Gallantry Cross Unit Citation with Palm and a Valorous Unit Award.
Those decorations should also be added to his separation document.
BOARD VOTE:

__BE ___ __HF ___ __RR ___ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing he was awarded the Purple Heart and that he is entitled to the
Republic of Vietnam Gallantry Cross Unit Citation with Palm and a Valorous
Unit Award.

The applicant requests that his records be corrected to reflect award of the Purple Heart and Bronze Star Medal with "V" device. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) does not reflect entitlement to the Purple Heart, or a Bronze Star Medal with "V" device. As such, the Board concludes that it would be appropriate, and in the interest of justice to confirm award of the Bronze Star Medal but amend the period of the award to coincide with his...

Although, there are no general orders that show the applicant was awarded the Purple Heart and the applicant's name is not listed on the Vietnam Casualty Roster, the applicant's DA Form 20 clearly shows that he sustained shrapnel wounds to his left arm on 13 November 1968. Based on the foregoing, the evidence provided is sufficient to support the applicant's entitlement to award of the Purple Heart in this case. As a result, the Board recommends that all Department of the Army records of...

The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief and to excuse failure to timely file. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. awarding him the Purple Heart for wounds received in action on 25 August 1968 in Vietnam; and b. amending his DD Form 214 for the period ending 16 May 1969 to add the Purple Heart and to show that he was awarded the Vietnam...

The applicant requests that his records be corrected to reflect award of the Silver Star and Purple Heart. The applicant served an initial tour of duty in Vietnam between October 1967 and February 1968. The evidence also confirms the applicant was wounded as a result of hostile action on 8 February 1968 and he is, therefore, entitled to an award of the Purple Heart.

The applicant's military personnel record shows he was inducted into the Army of the United States on 27 October 1966. The First Hospital Company Evacuation Manifest and the Republic of Vietnam Casualty Roster provides sufficient evidence to grant the applicant’s request for award of the Purple Heart. The applicant requests that his DD Form 214 (Report of Transfer or Discharge), be corrected to show that he was twice awarded the Purple Heart. The evidence of record establishes that the applicant was awarded the Purple Heart for wounds received on 26 May 1968. It would be appropriate to add these awards to his DD Form 214.

There is no evidence, or medical records, which confirm he was wounded as a result of hostile action while in Vietnam. The applicant did, however, have honorable service between 4 August 1966 and 14 March 1969 with no evidence of any misconduct. The applicant did, however, complete a qualifying period of service for award of the Good Conduct Medal on 14 March 1969 and the Board finds no basis to deny him the award for the period 4 August 1966 through 14 March 1969.

There are no orders in the applicant’s service personnel records which show that he was awarded the Purple Heart. Review of these records did not reveal any General Orders authorizing the applicant an award of the Purple Heart. Therefore, he is entitled to correction of his records to show these unit awards.
