      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his records be corrected to show award of
the Meritorious Unit Commendation.

2.  The applicant states, in effect, that while he was assigned to 696th
Ordinance Ammunition Company it was awarded the Meritorious Unit
Commendation.

3.  The applicant provides a copy of his DD Form 214 (Report of
Separation).

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of an alleged error which
occurred on 4 January 1954, the date of his separation from active duty.
The application submitted in this case is dated 2 December 2004.

2.  Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice.  This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitations if the ABCMR determines that it
would be in the interest of justice to do so.  In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.

3.  The applicant’s military records were damaged in the 1973 fire at the
National Personnel Records Center.  Although the records are damaged there
are sufficient records to allow the Board to conduct a fair and impartial
review of this case.

4.  The records show the applicant entered active duty on 5 January 1951,
served in Korea with the 696th Ordnance Ammunition Company from 5 September
1951 through 22 August 1953, and was honorably discharged on 4 January
1954.

5.  A DA Form 20 (Soldier's Qualification Card) and a 4 January 1954 DD
Form 214 indicate the applicant was authorized the Good Conduct Medal, the
National Defense Service Medal, the Korean Service Medal with three bronze
service stars, and the United Nations Service Medal.



6.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign
Participation Credit Register) indicates that the 696th Ordnance Ammunition
Company was cited for award of the Meritorious Unit Commendation for the
period 1 July – 31 December 1952.

DISCUSSION AND CONCLUSIONS:

In addition to the awards listed on the applicant's DD Form 214, he is
authorized the Meritorious Unit Commendation.  The applicant's records
should be corrected to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief and to excuse failure to timely file.  As a
result, the Board recommends that all Department of the Army records of the
individual concerned be corrected by showing the applicant is authorized
the Meritorious Unit Commendation.
