THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), ending on 31 December 1970, to show any awards for his service in Okinawa from 1967 to 1968.

2.  The applicant states he did not receive any awards for his service in Okinawa from 1967 to 1968.  He was assigned to the 175th Ordnance Company (Ammunition).  He is 82 years of age.

3.  The applicant provides a copy of his 1970 DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provide in the statute of limitations, the ABCMR has elected to conduct a substantive review of the cases and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are sufficient bases to waive the statute of limitations.
2.  The applicant's military records show he enlisted in the Regular Army (RA) on 4 August 1950.  He was honorably discharged on 3 August 1953 and he was issued a DD Form 214 (Report of Separation from the Armed Forces of the United States) for this period of service.

3.  He again enlisted in the RA, on 10 September 1953.  He served in Korea from 12 June 1954 through 20 October 1955.  He was honorably discharged on 7 September 1956 and he was issued a DD Form 214 for this period of service.

4.  He again enlisted in the RA, on 3 December 1956.  He served in Germany from 11 October 1956 through 16 November 1959.  He was discharged on 23 November 1959 for the purpose of immediate reenlistment.  He was issued a DD Form 214 for this period of service.

5.  He reenlisted in the RA on 24 November 1959.  He served in:

* Korea from 12 October 1960 through 6 October 1961
* Germany from 28 May 1963 through 12 March 1966

6.  He was discharged on 23 November 1965 for the purpose of immediate reenlistment.  He was issued a DD Form 24 for this period of service.  

7.  He reenlisted in the RA on 24 November 1965.  He served in:

* Vietnam from 10 January 1967 through 15 April 1967
* Okinawa from 15 April 1967 through 29 May 1968; he was assigned to the 175th Ordnance Company (Ammunition)
* Korea from 11 September 1969 through 1 May 1970

8.  He retired on 31 December 1970.  His DD Form 214 lists the:

* Republic of Vietnam Gallantry Cross with Palm Unit Citation
* Army Commendation Medal
* Armed Forces Expeditionary Medal
* Army Good Conduct Medal with Bronze Clasp – 3 Loops
* Korean Service Medal
* Vietnam Service Medal
* National Defense Service Medal with Oak Leaf Cluster

9.  Army Regulation 600-8-22 (Military Awards) does not cite any specific awards for service in Okinawa during the Vietnam War or any time periods. 

10.  Department of the Army (DA) Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) shows his unit, the 175th Ordnance Company, was cited for award of the Meritorious Unit Commendation for the periods:

* 31 October 1965 through 31 December 1966, by amended DA General Orders (DAGO) Number 30, dated 1968
* 1 July 1970 through 31 December 1971, by DAGO Number 40, dated 1972

DISCUSSION AND CONCLUSIONS:

1.  The applicant served in Okinawa from 15 April 1967 through 29 May 1968 and he was assigned to the 175th Ordnance Company.  Regrettably, he was not eligible for the Meritorious Unit Commendation for periods cited as he was not a member of this unit at the time.  Therefore, he is not entitled to this award and its addition to his DD Form 214 ending on 31 December 1970.

2.  It is also noted that Army Regulation 600-8-22 does not cite any specific awards for service in Okinawa during the Vietnam War or any time periods.
