      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his enlistment contract be corrected by
changing his term of service from 3 years and 00 weeks to 6 years and 00
weeks.

2.  The applicant states that his DD Form 4/1 and DD Form 4/3
(Enlistment/Reenlistment Document, Armed Forces of the United States),
should read 6 years 00 weeks, and not 3 years 00 weeks.

3.  The applicant provides copies of his DD Form 4/1, DD Form 4/2, and
     DD Form 4/3 with a corrected copy of his DD Form 4/3, a DA Form 4187
(Personnel Action), a Memorandum from the United States Military Academy
Preparatory School, and a statement from the applicant acknowledging the
error on his enlistment contract and his desire to have it corrected so he
can continue his service.

CONSIDERATION OF EVIDENCE:

1.  The DD Form 4/3 of the applicant's enlistment contract, shows that he
enlisted in the Regular Army for 3 years and 00 weeks on 18 January 2001.

2.  On 24 January 2001 and 3 June 2004 a DA Form 4187 states that the
Soldier’s term of enlistment was erroneously entered on DD Form 4/3, and
that his term of service should read 6 years and 00 weeks.

3.  On 9 August 2004, in a memorandum to the Commander, Human Resources
Commander – Alexandria, the applicant stated that he was aware of the error
made to his enlistment contract and would like the error corrected so that
he could continue his service in the U.S. Army, and that he understood that
his enlistment contract should read 6 years and 00 weeks.

4.  On 17 August 2004, the Deputy Commandant from the United States
Military Academy Preparatory School forwarded a memorandum to the Human
Resources Command-Alexandria in which he recommended approval of the
request to correct the applicant’s records.  He noted that despite the
error on the Soldier’s contract he wanted to continue his military service.


DISCUSSION AND CONCLUSIONS:

1.  An error was made during the preparation of the applicant’s enlistment
contract, which resulted in an incorrect term of service being shown on his
DD Form 4/3.
2.  The applicant's enlistment contract erroneously shows his term of
enlistment as 3 years and 00 weeks.  The DA Form 4187  requesting a
correction in the applicant’s term of service which was authenticated by
the Chief, Military Personnel Division, and a memorandum fro the Deputy
Commandant from the United States Military Academy Preparatory School,
confirmed that his DD Form 4/3 is incorrect and should be corrected to
reflect the term of enlistment as 6 years and 00 weeks.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing his term of enlistment as 6 years and 00 weeks.
