THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, that the Overseas Service Ribbon
(OSR) be added to his records.
2. The applicant states, in effect, that he completed a tour of duty in
the Republic of Korea in accordance with the guidelines established in AR
(Army Regulation) 600-8-22 for award of the OSR.
3. The applicant provides a copy of the DD Form 214, Certificate of
Release or Discharge from Active Duty, that he was issued on 24 February
1993; a copy of Orders 142-153, State of California, Office of the Adjutant
General, Sacramento, California, published on 22 May 2002; a copy of the
National Guard Bureau Form 22, Report of Separation and Record of Service
in the Army National Guard of California, with an effective date of 20
January 1995; a copy of Permanent Orders 57-1, Headquarters, 3rd Battalion
(Mechanized), 160th Infantry, Inglewood, California, dated 1 October 1994;
a copy of Orders
38-106, Office of the Adjutant General, Sacramento, California, dated 1
March 1994; and a copy of his DA Form 67-8, Officer Evaluation Report with
a through date of 21 September 1994.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the United States Army Reserve (USAR) for 8
years as a Cadet, on 16 October 1985. On 14 June 1987, he accepted a
commission as a Second Lieutenant in the USAR.
2. On 17 October 1992, the applicant was ordered to active duty for
training (ADT) to attend Infantry Office Basic Course, Class 1-93.
3. The applicant completed the Infantry Officer Basic Course and was
honorably released from ADT on 24 February 1993 and was returned to the
USAR Control Group (Reinforcement). Item 13 (Decorations, Medals, Badges,
Citations and Campaign Ribbons Awarded or Authorized (all periods of
service)), of the applicant's DD Form 214, shows he was awarded the Army
Service Ribbon; the Sharpshooter Marksmanship Qualification Badge, with
Automatic Rifle Bar [M-16 Rifle]; the National Defense Service Medal, and
the Army Reserve Components Achievement Medal.
4. On 26 January 1993, the applicant was appointed in the Army National
Guard of California.
5. On 27 March 1994, the applicant was ordered to active duty for special
work (ADSW) with his consent and the consent of the Governor of California
for 179 days (27 March 1994 through 21 September 1994), including travel
time. For this period, he was attached to the Army National Guard
Operating Readiness Center, Arlington, Virginia, with duty in Korea.
6. The applicant's officer evaluation report, for the period 27 March 1994
through 21 September 1994 that he submitted in support of his request,
shows that he served in Korea as a Special Project Officer for Ulchi Focus
Lens for 6 months.
7. On 20 January 1995, the applicant was honorably separated from the Army
National Guard of California and was transferred to the USAR Control Group
(Reinforcement). The applicant was provided an NGB Form 22, Report of
Separation and Record of Service, on his separation.
8. Item 15 (Decorations, Medals, Badges, Commendations, Citations and
Campaign Ribbons Awarded this period), of the NGB Form 22, shows he was
awarded the Army Service Ribbon, the Parachutist Badge, the National
Defense Service Medal, the Army Reserve Components Overseas Training Ribbon
(3), the Army Reserve Components Achievement Medal (2), and the California
Drill Attendance Ribbon. [The applicant also received the ARCM; however,
the acronym/abbreviation cannot be identified.] The Overseas Service
Ribbon is not shown on his NGB Form 22.
9. Army Regulation (AR) 614-30 provides policy and guidance on tour
lengths for Soldiers serving overseas. Prescribed overseas tour lengths
are listed in Appendix B. The normal tour of duty in the Republic of Korea
for Soldiers serving a dependent restricted ("all others") tour of duty is
12 months.
10. AR 600-8-22 shows that the Secretary of the Army established the
Overseas Service Ribbon on 10 April 1981. The regulation states, in
pertinent part, that effective 1 August 1981, all members of the Active
Army, Army National Guard, and Army Reserve in an active Reserve status are
eligible for the award for successful completion of overseas tours. The
award may be awarded retroactively to those personnel who were credited
with a normal overseas tour completion before 1 August 1981 provided they
had an Active Army status on or after 1 August 1981 and the overseas
service is not recognized with another U.S. service medal.
DISCUSSION AND CONCLUSIONS:
1. The applicant was ordered to active duty for special work (ADSW) and
served in the Republic of Korea for 6 months.
2. The OSR is awarded for successful completion of a normal overseas tour.
The normal overseas tour of duty in Korea is 12 months.
3. The applicant did not complete a 12-month overseas tour of duty in
Korea. He is therefore not eligible for award of the OSR and to have it
added to his records.

BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.
