         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military records.

         Exhibit B - Military Personnel Records (including advisory opinion, if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, promotion consideration for major.

2. The applicant states that when she transferred from the Army Nurse Corps to the Medical Corps her date of rank was never adjusted and she was not considered for promotion to major by the Army Medical Department selection board until 2000. The 2000 Army Medical Department promotion selection board promoted her based on her prior Army Nurse Corps date of rank.

3. The applicant provides a continuation sheet in support of her application.

CONSIDERATION OF EVIDENCE:

1. Based upon review of the applicant’s records by the Office of Promotions, Reserve Components, Army Human Resources Command, it was determined the applicant was erroneously not considered and is eligible for consideration for promotion to major by a Special Selection Board (SSB) under the1996, 1997 and 1998 criteria as an omit.

2. Current promotion policy specifies that promotion reconsideration by a SSB may only be based on erroneous non-consideration or material error that existed in the record at the time of consideration.

DISCUSSION AND CONCLUSIONS:

1. The applicant’s records were erroneously not considered for promotion to major by the 1996, 1997 and 1998 Reserve Components Selection Boards and should now be submitted for appropriate SSB consideration for this purpose.

2. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by submitting her records to duly constituted SSB's as deemed appropriate for promotion consideration for major under the 1996, 1997 and 1998 criteria.

2. That if selected, her records be further corrected by showing she was promoted to the next higher grade on her date of eligibility therefore, as determined by appropriate Departmental officials using the criteria cited, provided she was otherwise qualified and met all other prerequisites for promotion.

3. That if not selected, the applicant be so notified.
