THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his date of rank (DOR) on his report of separation (DD Form 214) reflects the incorrect date.
2. The applicant states, in effect, that his DOR on his DD Form 214 reflects that he was advanced to the pay grade of E-4 on 3 December 2005, a date that has not arrived. He also states that his DOR is later than his separation date and is preventing him from competing for promotion to the pay grade of E-5 in the Air Force.
3. The applicant provides a copy of his DD Form 214.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in Wuerzburg, Germany, on 27 January 1998, for a period of 2 years and 23 weeks, training as a quartermaster and chemical repairer, and enrollment in the Army College Fund. He completed his training and was transferred to Germany.
2. He was advanced to the pay grade of E-3 on 1 October 1998 and to the pay grade of E-4 on 1 October 1999.
3. On 5 July 2000, he was honorably released from active duty (REFRAD) in the pay grade of E-4, due to completion of required service. He had served 2 years, 5 months, and 9 days of total active service and was transferred to a Virginia Army National Guard (VAARNG) unit in Fredericksburg, Virginia. His DD Form 214 issued at the time of his REFRAD indicates in block 12h, that his effective date of pay grade was 3 December 2005.
4. The applicant continued to serve in the VAARNG until he was honorably discharged for the purpose of enlisting in the Air Force, where he is currently serving.
DISCUSSION AND CONCLUSIONS:
1. The applicant was advanced to the pay grade of E-4 on 1 October 1999 and was discharged in that pay grade on 5 July 2000. However, his DD Form 214 incorrectly reflects a future DOR of 3 December 2005.
2. Accordingly, it would be in the interest of justice to correct his DD Form 214 to reflect in block 12h, that his DOR is 1 October 1999.
