RECORD OF PROCEEDINGS
IN THE CASE OF:
BOARD DATE: 1 April 2004
DOCKET NUMBER: AR2004101467
I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.
| |Mr. Carl W. S. Chun | |Director |
| |Mrs. Victoria A. Donaldson | |Analyst |
The following members, a quorum, were present:
| |Mr. Fred N. Eichorn | |Chairperson |
| |Mr. Walter T. Morrison | |Member |
| |Mr. John T. Meixell | |Member |
The applicant and counsel if any, did not appear before the Board.
The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that the character of her discharge be changed
from uncharacterized to honorable.
2. The applicant states that the character of her discharge should be
honorable because many people do not recognize "uncharacterized" discharges
and that the uncharacterized discharge affects employment, purchasing homes
and many other things.
3. The applicant does not provide documentary evidence in support of this
application.
CONSIDERATION OF EVIDENCE:
1. Evidence of record shows that the applicant enlisted in the United
States Army Reserve (USAR) on 15 May 1991 for eight years. The applicant
completed basic and advanced training and was awarded the military
occupational specialty 91A00 (Medical Specialist). Upon completion of her
training, the applicant transferred to the United States Air Force Reserves
to complete her military service obligation.
2. Evidence of record shows that the applicant has completed 5 months and
20 days of active service at the time of her separation.
3. The applicant's DD Form 214 (Certificate of Release or Discharge From
Active Duty) shows in block 23 (Type of Separation) the entry "Release from
ADT (Active Duty for Training)" and in block 24 (Character of Service) the
entry "uncharacterized."
4. This form also shows in block 25 (Separation Authority) the entry "MEPS
Self-Terminating Orders 098-015 dtd (dated) 910523 CRSE 91B" and in block
28 (Narrative Reason for Separation) the entry "Completion of Period of
ADT."
5. On 12 March 2003, the applicant applied to the Army Discharge Review
Board (ADRB) requesting that her uncharacterized discharge be changed to an
honorable discharge.
6. On 28 January 2004, the ADRB considered the applicant's request and
unanimously determined that the applicant was not entitled to relief.
7. On 30 January 2004, the applicant was notified in writing of the ADRB
decision that her request for a change in the character of her discharge
was denied.
8. Army Regulation 635-200 (Active Duty Enlisted Administrative
Separations) sets forth the basic authority for separation of enlisted
personnel. Chapter 4, in pertinent part, provides for the separation or
release from active duty upon termination of enlistment and other period of
active duty or active duty for training. Specifically, individuals of the
USAR ordered to active duty who have completed less than 180 days of
continuous active duty will have their service uncharacterized, even though
they have completed Individual Active Duty for Training.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends that her DD Form 214 should be corrected to show
that she was honorably discharged.
2. The applicant did not complete 180 days of continuous active service
prior to her separation from the United States Army Reserve.
3. There is no evidence and the applicant has failed to provide evidence
which shows that the "uncharacterized" discharge is in error or otherwise
contrary to law or regulations. Therefore, there is no basis to change the
applicant's character of service as requested.
BOARD VOTE:
________ ________ ________ GRANT RELIEF
________ ________ ________ GRANT FORMAL HEARING
_WTM___ _FNE___ _JTM___ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.
