      The applicant and counsel if any, did not appear before the Board.

      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his enlistment contract be corrected to
show his correct enlistment grade.

2.  The applicant states that his DD Form 4/1 (Enlistment/Reenlistment
Document-Armed Forces of the United States), should read “beginning in pay
grade E-5,” and not, “beginning in pay grade E-7.”

3.  The applicant provides a copy of his DD Form 4/1 and DD Form 4/2, a
Memorandum of Record (MFR) for the U/S. Army Recruiting Command, 43rd
Adjutant General Battalion, Fort Leonard Wood, Missouri, and copy of DD
Form 214 (Certificate of Release or Discharge from Active Duty) from the
United States Navy.

CONSIDERATION OF EVIDENCE:

The applicant's request for correction of enlistment data, if approved by
the Army Board for Correction of Military Records (ABCMR), results in a
change to the applicant's enlistment grade.  As a result, the staff of the
ABCMR notified all applicants who filed similar requests to affirm that
they understood the options contained in their enlistment contracts, that
they want the requested change made, and that the request was made without
coercion and for the benefit of the applicant.  Each applicant was provided
30 days to respond and, in the absence of a response, the application would
be considered by the ABCMR.  In this case, the applicant did not respond
within the 30 days allotted and the case is being considered by the ABCMR.

2.  The applicant’s DD Form 214, indicates he was discharged from the Navy
on 6 November 2003, in the pay grade of E-5, upon completion of required
service.

3.  The applicant’s DD Form 4/1, shows that he enlisted in the Regular Army
on
7 November 2003, in the pay grade of E-7.

4.  Army Regulation 601-210, provides in pertinent part, that a soldier who
is separated from any component, in the pay grade of E-5, and does not have
more than 10 years of active Federal service, and enlist within 24 months
of separation, will enlist in the Regular Army in the pay grade of E-5.

5.  A statement from the Senior Recruiting Policy Office, Army G1, states
that the applicant was erroneously promoted to pay grade E-7 at the time of
his enlistment, due to no fault of his own.  However, he was not authorized
the pay grade of E-7.  It was determined that rather than penalize the
soldier for actions that occurred beyond his control, he was authorized to
retain pay grade E-5 as his enlistment grade.  However, he was required to
successfully complete the Primary Leadership Development Course within one
year after his arrival at his first duty station in order to retain pay
grade E-5.

6.  On 16 December 2003, a Memorandum For Record (MFR) from the U.S. Army
Recruiting Command (USAREC), 43d Adjutant General Battalion, Fort Leonard
Wood, Missouri, confirms that the DD Form 4/1 is incorrect and his
enlistment grade should be corrected to read, “beginning in pay grade E-5”,
instead of “beginning in pay grade E-7.”

DISCUSSION AND CONCLUSIONS:

1.  An error was made during the preparation of the applicant’s enlistment
contract, which resulted in an incorrect grade being shown on his DD Form
4/1.

2.  The applicant's DD Form 4/1 erroneously shows his enlistment grade as
E-7.  The MFR from USAREC dated 16 December 2003, and the statement from
the Senior Recruiting Policy Office, Army G1, confirmed that the DD Form
4/1 is incorrect and should be corrected to reflect his enlistment grade as
E-5.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
showing the applicant enlisted in the Regular Army on 7 November 2003, in
the pay grade of E-5.
