THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, promotion consideration to chief warrant officer four (CW4) under the 1993 criteria.
2. The applicant states, in effect, that he was notified that he was not educationally qualified for promotion to CW4. He completed the Aviation Warrant Officer Advance Course and was indeed educationally qualified.
3. The applicant provides no documentation in support of his application.
CONSIDERATION OF EVIDENCE:
1. Based upon review of the applicant’s records by the Office of Promotions, Reserve Components, Army Human Resources Command, it was determined the applicant was erroneously not considered and is eligible for consideration for promotion to CW4 by a Special Selection Board (SSB) under the 1993 criteria.
2. Current promotion policy specifies that promotion reconsideration by a SSB may only be based on erroneous non-consideration or material error that existed in the record at the time of consideration.
DISCUSSION AND CONCLUSIONS:
1. The applicant’s records were erroneously not considered for promotion to CW4 by the 1993 Reserve Components Selection Board and should now be submitted for appropriate SSB consideration for this purpose.
2. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.

Current promotion policy specifies that promotion reconsideration by a special selection board (SSB) may only be based on erroneous non-consideration or material error, which existed in the records at the time of consideration. The Chief, Promotion and Notifications Branch, Office of Promotions, PERSCOM, expressed the opinion that based on the 6 years time in grade requirement, the applicant was in zone for promotion consideration by the 1991 through 2001 RCSB’s. The Board notes that the...

His records did not show the date he completed the WOSC when reviewed by the selection board. Army Regulation 135-155 also indicates that effective in 1994 completion of any WOSC is required for promotion to CW4. Notwithstanding the opinion received in this case, it is also noted that while the WOSC completion certificate is not dated, the applicant’s records show he completed the WOSC in 1987 and is educationally qualified for promotion to CW4.

The applicant requests, in effect, waiver of his military education requirement for promotion to major and appearance before a Special Selection Board (SSB). The evidence of record shows the applicant completed all requirements for his baccalaureate degree four months prior to the March 2001 RCSB; however, Excelsior University failed to confer the applicant's degree prior to the convening date of the March 2001 RCSB. As a result, the Board recommends that all Department of the Army records...

The applicant requests adjustment to his promotion effective date and date of rank for captain. He was erroneously not considered for promotion to captain by the 2000 Reserve Components Selection Board. If the applicant is selected, his records should be further corrected by showing he was promoted to captain on his date of eligibility as determined by appropriate Departmental officials using the criteria cited, provided he was otherwise qualified and met all other prerequisites for promotion.

The applicant’s records were erroneously not considered for promotion to major by the 1996, 1997 and 1998 Reserve Components Selection Boards and should now be submitted for appropriate SSB consideration for this purpose. BOARD DETERMINATION/RECOMMENDATION: The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.

The available records indicate that the applicant's completed his education requirement on 18 April 2006. While it is the applicant's responsibility to complete his promotion educational requirement in a timely manner and to ensure that this records are complete at the time of promotion consideration, the applicant's contention that his Certificate of Training for the successful completion of the AWOAC was not in his file at the time that he was considered for promotion to CW4 is not...

The opinion also stated that the Army Board for Correction of Military Records is the office that has the authority to grant a waiver for education for past criteria. The applicant had not completed his military education by the convening dates of the 2001 and 2002 promotion boards, he was not qualified for promotion without the 50 percent completion of the CGSOC, and he is also not entitled to promotion reconsideration to major under the 2002 criteria. BOARD DETERMINATION/RECOMMENDATION:
