                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 16 August 2005
      DOCKET NUMBER: AR20040010961

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Ms. Deyon D. Battle | |Analyst |

The following members, a quorum, were present:

| |Mr. Melvin H. Meyer | |Chairperson |
| |Mr. John T. Meixell | |Member |
| |Mr. James B. Gunlicks | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that her Enlistment Contract be corrected to
show that she enlisted in the Army for 3 years and 00 weeks.

2. The applicant states, in effect, that her Enlistment Contract
erroneously shows that she enlisted in the Army for 1 year and 36 weeks.

3. The applicant provides in support of her application a Memorandum For
Record (MFR) from Headquarters, United States Army Recruiting Command
(USAREC) Liaison confirming that the years of service on her Enlistment
Contract should read 3 years and 00 weeks; a Statement of Understanding
dated 1 November 2004; a copy of her Reservation Sheet; a copy of portions
of her Enlistment Contract (DD Forms 4/1 and 4/3); and a copy of her
Regular Army Applicant Data Report.

CONSIDERATION OF EVIDENCE:

1. The applicant’s Reservation Sheet shows that when she enlisted in the
Army on 28 October 2004, she enlisted for a period of 3 years and 24 weeks.
However, her DD Form 4/3 shows her term of enlistment as 1 year and
36 weeks.

2. The MFR from the USAREC dated 11 November 2004, which was submitted by
the applicant in support of her application, confirms that the DD Form 4/3
is incorrect and that it should be corrected to reflect her term of
enlistment as 3 years and 00 weeks.

3. In the Statement of Understanding dated 1 November 2004, which she
submitted in support of her application, she states that she understands
the available options under her enlistment contract and that she was
submitted her application under no coercion and for her own benefit.

DISCUSSION AND CONCLUSIONS:

1. It is clear that errors were made during the preparation of the
applicant’s enlistment process, which resulted in the incorrect term of
service being reflected on her Enlistment Contract.

2. The applicant has submitted sufficient evidence to show that it was her
intention to enlist in the Army for 3 years and 00 weeks on 28 October
2004. Although her Reservation Sheet shows an entirely different date than
that reflected on the Enlistment Contract, the MFR from the USAREC shows
her term of enlistment as 3 years and 00 weeks and her DD Form 4/3 should
be corrected accordingly.

3. In view of the foregoing, the applicant’s records should be corrected
as recommended below.

BOARD VOTE:

__mhm___ __jtm___ __jbg___ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
amending her DD Form 4/3 to show that on 28 October 2004, she enlisted in
the Regular Army for 3 years and 00 weeks.
