                            RECORD OF PROCEEDINGS

      IN THE CASE OF:

      BOARD DATE: 26 JULY 2005
      DOCKET NUMBER: AR20040009068

I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.

| |Mr. Carl W. S. Chun | |Director |
| |Ms. Gale J. Thomas | |Analyst |

The following members, a quorum, were present:

| |Ms. Linda Simmons | |Chairperson |
| |Mr. Patrick McGann | |Member |
| |Mr. Leonard Hassell | |Member |

The Board considered the following evidence:

Exhibit A - Application for correction of military records.

Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that his 20 March 2002, DD Form 214 (Certificate
of Release or Discharge from Active Duty) be corrected to show his correct
date of entry on active duty.

2. The applicant states that entered the Army on 18 March 1995, and not
March 1991. He states that he was in the Navy between 19 July 1990 and
19 July 1994.

3. The applicant provides copies of his Navy and Army discharge
certificates in support of his request.

CONSIDERATION OF EVIDENCE:

1. The applicant’s 19 July 1994, DD Form 214 shows he served in the United
States Navy from 20 July 1990 to 19 July 1994, as the applicant contends.

2. His DD Form 4/1 (Enlistment/Reenlistment Document, Armed Forces of the
United States) shows he enlisted in the Regular Army on 15 March 1995, for
a period of 3 years, in the pay grade of E-4.

3. The applicant’s 20 March 2002, DD Form 214 indicates he entered active
duty on 15 March 1991 and that he had 11 years and 6 days of active service
during the period of service covered by the separation document.

DISCUSSION AND CONCLUSIONS:

1. The applicant served in the United States Navy from 20 July 1990 to 19
July 1994, and could not have been on active duty with the Army during the
same time period.

2. The applicant enlisted in the Regular Army on 15 March 1995, and not on
15 March 1991, as reflected on his 20 March 2002, DD Form 214. The
applicant’s DD Form 214 should be corrected to reflect the correct entry on
active duty date of 15 March 1995 and his service computation adjusted
accordingly.

The applicant's military personnel records contain a DA Form 4037 (Officer Record Brief), prepared 9 November 1994. Therefore, it would be appropriate to correct item 18 of the applicant’s DD Form 214 to show she served in SWA from 27 September 1990 to 11 April 1991. The evidence of record shows that the applicant was credited with completing 5 months and 11 days of foreign service during the period of service under review.
