The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his latest DD Form 214 (Certificate of
Release or Discharge from Active Duty) be corrected to show his enlisted
service. He also requests that the Defense Meritorious Service Medal
(DMSM) be added to his latest DD Form 214.
2. The applicant states that his DD Form 214 for the period ending 29
February 2004 does not reflect his enlisted service from 15 March 1971
through 14 March 1975. Due to this error, the Department of Veterans
Affairs (VA) will not process his medical action.
3. The applicant provides a letter to the National Personnel Records
Center dated 22 March 2004; his DD Form 214 for the period ending 14 March
1975; his DD Form 214 for the period ending 29 February 2004; his Reserve
Officers' Training Corps (ROTC) enlistment contract; his appointment
letter; two oaths of office; two sets of active duty orders; an application
for extension of service with approval; his retirement orders with
amendment; and his DMSM orders with certificate, citation, and narrative.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Air Force on 15 March 1971. He
was released from active duty on 14 March 1975 after completing 4 years of
creditable active service.
2. On 7 September 1976, the applicant enlisted in the U. S. Army Reserve
Control Group (ROTC). He completed ROTC and accepted appointment as a
second lieutenant on 21 July 1977. Both sets of active duty orders
provided by the applicant show he was accessed into the Active Army on 2
October 1977. He remained on active duty until he was released from active
duty on 29 February 2004 for the purpose of retirement.
3. Item 12a of the applicant's DD Form 214 for the period ending 29
February 2004 shows he entered active duty that period on 2 October 1973;
item 12c shows he completed 30 years, 4 months, and 29 days of net active
service that period; and item 12d shows he completed a total of 4 years
prior active service. Item 12e shows he completed a total of 2 years, 6
months and 17 days of total prior inactive service. The DMSM is not listed
on his DD Form 214.
4. Orders dated 24 March 2004 awarded the DMSM to the applicant.
5. Army Regulation 635-5 prescribes the separation documents prepared for
Soldiers upon retirement, discharge, or release from active military
service or control of the Army. It establishes standardized policy for the
preparation of the DD Form 214. In pertinent part it states that the DD
Form 214 is a synopsis of the Soldier’s most recent period of continuous
active duty.
6. The Department of Defense Financial Management Regulation, Volume 7A,
paragraph 010101 provides for creditable service for basic pay. This
paragraph states, in pertinent part, that service as a member of the Army,
Navy, or Air Force Reserve Officers' Training Corps is creditable service
provided the member has concurrent Selected Reserve (drilling status).
DISCUSSION AND CONCLUSIONS:
1. Although there are administrative errors on the applicant's DD Form 214
for the period ending 29 February 2004, it already shows his prior enlisted
service.
2. The applicant had 4 years of prior active duty for which he received a
DD Form 214. Since the DD Form 214 is a synopsis of a Soldier's most
recent period of continuous active duty, his latest DD Form 214 would not
show that he entered active duty on 15 March 1971, the date he enlisted in
the Regular Air Force. His service in the Regular Air Force would be, and
is, listed in item 12d of his latest DD Form 214. The VA should be aware
that his prior active service is listed on his latest DD Form 214 from
reading item 12d and from looking at his previous DD Form 214.
3. Item 12a of the applicant's DD Form 214 for the period ending 29
February 2004 contains an obvious error. He entered active duty for that
period on 2 October 1977, not 2 October 1973. That error created
an error in item 12c. He completed 26 years, 4 months, and 29 days of net
active service that period, not 30 years, 4 months, and 29 days of net
active service.
4. The DMSM is not listed on the applicant's DD Form 214 for the period
ending 29 February 2004 as it was not awarded to him until after he
retired.
5. It is also noted that item 12e of the applicant's DD Form 214 for the
period ending 29 February 2004 contains an error. The entry would be
correct if he had served in the U. S. Army Reserve (other than Control
Group (ROTC)) for the entire period from 15 March 1974 (when he was
transferred from the Regular Air Force to a Reserve status) until 1 October
1977 (the day before he reentered active duty). However, the period of
time he was in ROTC was not creditable for pay purposes and therefore was
not inactive service.
6. The applicant's creditable prior inactive service included the period
15 March 1975 through 6 September 1976 (1 year, 5 months, and 22 days) and
the period 21 July 1977 through 1 October 1977 (2 months and 11 days) for a
total period of 1 year, 8 months, and 3 days. However, because he does not
request this correction it is not a part of this action.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief. As a result, the Board recommends that the DD
Form 214 for the period ending 29 February 2004 of the individual concerned
be corrected:
a. in item 12a to show he entered active duty on 2 October 1977;
b. in item 12c to show he completed 26 years, 4 months, and 29 days
of net active service that period;
c. in item 13 (Decorations, Medals, Badges, Citations and Campaign
Ribbons Awarded or Authorized) to add the Defense Meritorious Service
Medal.
