         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Certificate of Release of Discharge from Active Duty) be amended to add the Legion of Merit.

3. The applicant states that he was awarded the Legion of Merit at his last duty station.

4. The applicant’s military records show that, after having had prior service, he reenlisted in the Regular Army on 25 June 1982. He retired on 1 February 2000.

5. The applicant was awarded the Legion of Merit by Headquarters, U. S. Army Combined Arms Support Command and Fort Lee, Fort Lee, VA on Permanent Order Number 033-019 dated 2 February 2000.

CONCLUSIONS:

1. The evidence of record shows the applicant was awarded the Legion of Merit after he retired. His DD Form 214 for the period ending 31 January 2000 should be amended to add the Legion of Merit.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant's DD Form 214 for the period ending 31 January 2000 be amended to add the Legion of Merit.
