APPLICANT REQUESTS: That he be awarded the Purple Heart.
APPLICANT STATES: That he was wounded in a mission over the Tra Vin Province in Vietnam on 23 December 1969 and was never awarded the Purple Heart.
EVIDENCE OF RECORD: The applicant's military records show:
After serving enlistments in the Navy and Marine Corps, he enlisted in the Regular Army on 8 September 1960. He was transferred to Vietnam on 8 June 1969 and was promoted to the pay grade of E-7 on 9 September 1969. He was assigned to the 121st Aviation Company as a helicopter maintenance supervisor.
He departed Vietnam on 7 June 1970 and continued to serve until he was honorably released from active duty on 31 July 1973 and was placed on the Retired List, effective 1 August 1973, in the pay grade of E-7. He had served 20 years, 10 months and 21 days.
A review of the applicant's personnel and health records, to include his retirement physical examination, fails to show that he was ever wounded or that he was treated for any wounds.
Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was a result of hostile action, that the wound must have required treatment by a medical officer, and that the medical treatment was made a matter of official record.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. The evidence of record fails to show that the applicant was wounded/injured as a result of enemy action; therefore, there is no basis for the Board to award him the Purple Heart.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
