APPLICANT REQUESTS: That the date of induction currently reflected on his Report of Separation (DD Form 214) be corrected to show that he was inducted into the Army on 27 September 1965 instead of 29 November 1965 as currently reflected.
APPLICANT STATES: That he entered on active duty in the Army on 27 September 1965.
EVIDENCE OF RECORD: The applicant's military records show:
According to his Record of Induction and all other available documentation maintained in his Official Military Personnel Jacket, he was inducted into the Army on 29 November 1965, in Philadelphia, Pennsylvania. He successfully completed his training as an ammunition agent.
He was released from active duty and he was transferred to the United States Army Control Group on 24 September 1967. He had completed 1 year, 9 months and 26 days of total active service.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The actions by the Army in this case were proper, and there is no doubt to be resolved in favor of the applicant.
2. The Board has noted the applicant’s contentions. However, they are unsupported by the evidence of record. His records clearly show that he was inducted into the Army on 29 November 1965 and he has failed to submit any evidence to the contrary. Therefore, the Board has determined that his records are correct as currently reflected.
3. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
